San Marcos Cpl. jailed after illegally arresting pedestrian

SAN MARCOS, Texas -- A police officer in San Marcos is in jail after arresting a pedestrian whom police say didn’t break the law.

Corporal James Angelo Palermo, 40, conducted a traffic stop on May 29 during his midnight shift patrol near 126 S. Guadalupe Street.

According to the arrest affidavit, Palermo stopped a Toyota Prius shortly after 1:00 a.m. for driving the wrong way on a one-way street and began questioning the driver.

A pedestrian walking by was called over by Palermo and asked why she was walking by his traffic stop. He then asked for the woman’s identification.

When the woman insisted she had done nothing wrong Palermo slammed her against the Prius; then onto the concrete driveway near his patrol car.

Palermo arrested the woman for obstruction. After his supervisors reviewed his report and talked to the pedestrian she was released.

Upon further investigation supervisors found the woman had lost two teeth and suffered a concussion during the illegal arrest.

Palermo was arrested for aggravated assault by a public servant. The woman is currently being treated for her injuries and could require further surgery, according to the affidavit.

The department issued the following statement:

"Cpl. James Palermo of the San Marcos Police Department was arrested Tuesday, July 16 and charged with aggravated assault with serious bodily injury by a public servant, a first degree felony, in connection with an incident that occurred May 29 in which a woman suffered serious injuries during an arrest. Police Chief Howard Williams ordered an internal investigation on May 30.

Employed by the SMPD since 2000, Palermo has been on paid administrative leave since June 10 while the San Marcos Police Department conducted the investigation. The arrest was reviewed by the Hays County District Attorney’s Office and by a prosecutor with the Texas Attorney General’s Office.

Palermo was booked in the Hays County Law Enforcement Center Tuesday afternoon and awaits magistration."

I suggest you do a ride along for a police beat down or paranoid shooting. It is easy to make excuses for bad judgement, if others pay the pricefor your mistakes.

Let’s’ see. 180 pound male cop throws an unarmed 100 pound woman to the ground and damages her permently. No evidence of a weapon and I am pretty sure she didn’t have an AK under coat since it is Texas in the Summer.

Sorry cop was wrong. There are 50 ways to subdue and hook up a “suspect” that do not involve slamming them on the ground.

“Texas’s law requires a person to provide their name, residence address and date of birth if lawfully arrested and asked by police. (A detained person or witness of a crime is not required to provide any identifying information, however it is a crime for a detained person or witness to give a false name.)”

The victim was not lawfully arrested and asked by police. She was not detained.

They actually speak to slightly different issues. I can say Brown v. Texas here, and the constabulary knows they aren't getting an ID.

Ken5050 is kidding. Generally FReepers don't achieve that level of stupid. Even Liberals have to try hard to smack that level of stupid on the nose. Thus, he must be pushing the razor's edge of sarcasm and not being serious. Why do I think so?

Because of this statement he made '.."Better to be judge by 12 than carried by 6." The same logic, and privilege should apply even more so to cops' where he basically advocates the cop going as far as shooting the lady because she MAY have been trying to kill him.

He is joking. No one is that stupid ...not even a cop. At that level of stupid, were he not joking, he'd probably have walked blind-folded into traffic or stuck his gonads in a blender or some other equally 'Darwin-esque' self-elimination by now. Thus, he must be joking. ;)
