I've been saying this for years. A man who drives drunk is guilty, even if (especially if) he's too drunk to realize he's driving drunk. Meanwhile, if two drunk people have sex, then the woman is presumed to be unable to give consent, but the equally drunk man is presumed to have the judgement to realize that she's not qualified to give consent. BS.
The only exception I would make is if the woman is physically unconscious and completely unaware of what's happening.
In the event of the couple being married, I would presume the marriage vows constitute consent in the absence of explicit withdrawal of consent.
