If I remember correctly, it was a Keltec 9mm.
It is my understanding that the pistol was a double-action firearm without a safety, and the hammer was almost certainly NOT cocked while in his pocket. However, it is doubtful if there is any evidence that it was cocked before the confrontation.
Cock and lock IS proper defensive posture...
