Tried back in the 90’s by an 80-something year old woman who spilled coffee on herself ... she got some $2 million from the jury. If I remember public opinion was on McDonald’s side however the jury saw it different.
They made a documentary about her. Apparently she did suffer some substantial burns because she was pushing 90 and her skin was especially vulnerable. Particularly in the area of her lap where she spilled it. Still not McD’s fault.
Judgement was reduced to a pitiance on appeal though. Most people don’t know that.
Yes, but the backstory is that Micky Dee's started offering free coffee refills, and had deliberately jacked up the coffee temperature to make to too hot to slurp to slow down the drinkers and reduce the number of refills one could drink in a given time period.
That's why they lost, they were deliberately putting out a dangerously scaldingly hot product, a sudden change made without any notice or warning.
