Unwanted physical contact is battery, as I understand it. She was poking him and threatening harm. If the roles had been reversed -— him poking her, whilst swearing and threatening -— I think you would see the point.

But in any case, the category of "hate crime" is stupid. "Hate" as compared to what?
Battery will do for a charge plain and simple, without any further spice, sauce or garnish.
