OK, but if he is tried in a US court I could see that alone as getting him a acquittal. He should have been declared a foreign terrorist and be tried at GITMO by a military tribunal. I also bet there will be a big issue whether he will be tried in a state or federal court. The Obama administration will have a real problem if this guy walks or is given some light sentence by a civilian court.
