The man that allowed the dog to run loose and unattended should be charged with negligence and endangering the life of others.

If he was in his owners' front yard, as reported, he wasn't running loose.

According to local law the dog still has to be leashed or behind a fence.

An unleashed dog in an unfenced front yard IS most definitely running loose.
