IV. Right of search and seizure regulated

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Warrantless searches are OK to stop pirating of intellectual property, but you can’t inquire of someone’s citizenship.

If I’m ever on a jury for this charge and the search was without a warrant, I’m voting not guilty.

Gov. Perdue: Let’s suspend elections. Only temporarily of course.

Gov. Brown: We can search for whatever we want whenever we want. We will get back to you when we reinstate that pesky search and seizure thing.

California...always on the cutting edge of liberalizing or ignoring the Constitution. There’s another case out of CA that I think might be before the SC now about the placement of GPS on a car by law enforcement without a warrant. Will someone search houses for those who own fake CDs and DVDs? The same logic applies to that situation. And search everyone’s computer for downloaded songs and movies.
All digital data in any format now becomes came with this ruling.

So, in California, SWAT teams will be knocking down your door to check out your DVDs and hard drives? Do they get to shoot you if you resist?
