Ok. Well, first, I never turn my back on anyone with a loaded weapon. Second, I'm smart enough to know a twitch doesn't warrant 5 shots to the abdomen....third, I'm not dumb enough to execute an un-armed man on the floor in front of security cameras. Have a nice day.
We had a similar case many years ago in California. Party B jumps party A. Party A takes away the knife from party B and then stabs party B. Up to here self defense is in play. HOWEVER, party B falls into the gutter and is laying there disabled when Party A stabs party B again and kills him. Party A claimed self defense and the court rejects the claim saying he should have stopped when party B was disabled.
The mother is a real piece of work. At least I don’t have to worry about her son trying to rob me. (this one anyway)
Yes, and the DA makes that clear. You can pretty much do anything as long as you can keep it close to or connected to, the “heat of battle” area, but you cannot do what Ersland did.
I’ve seen the video many times. If the head shot was so bad, five more shouldn’t matter. If not, he posed a perceived threat. Hardly first degree murder. Still wouldn’t have happened without speedy goin in to rob the place.
The coroner and forensics could show that the unconcious, (brain wounded) body was on it’s back with arms splayed palms up, when the bullets were pumped into it (and it never reacted to the bullets).
I am surprised that OK of all places would do this. It looks like it was self defense.
It sounds like all of the bad guys have met justice in this little story.
Emptying a clip from a revolver is quite a feat. Looks like Ersland isn't the only liar here.

The five murder shots came from a Kel-Tec 380.

The other robber received a sentence for armed robbery as juvenile. He will be released at 21 if he behaves. The 2 adults who recruited the teens were convicted of murder as well and received life terms.One of the adult rocket scientists attacked and punched out the DA in the court room after the verdict and sentencing. He bought another felony assault charge on that one..red

There was movement from the suspect on the floor, the video backs this up. How did the robbery victim know the suspect was not going to suddenly pull a gun and kill him?

Depending on which version you believe. I was going with one of the two versions you cut&pasted.
Ersland also kept a much larger pistol in a nearby drawer, which he was able to retrieve, a Taurus Judge revolver. At that point, the second robber took off. However, the other robber was now getting up off of the floor, despite the head wound.
Ersland emptied his clip into the chest of the wounded robber, who turned out to be 16-year-old Antwun Parker.
Agreed 100%. It's been a while since I watched the video but if I remember correctly there was something like 16 seconds between the time he stepped over the kid to get back behind the counter and when he came back over and shot the kid who still hadn't moved. I'm all for self defense but when the threat has been eliminated you had better stop shooting.
