The FCC alleges that Lloyd Morris and Robert Brown were engaged in the operation of an unlicensed FM station at 99.7 in the Mattapan neighborhood of Boston, Massachusetts. Over six months ago (October 1, 2010), the Commission issued a $15,000 Notice of Apparent Liability against both men, and neither has filed a response. The next step for the FCC is to "affirm the forfeiture" with forfeiture orders.

Shortwave (HF) pirate stations have been fun to track and listen to for decades. I have operating schedules and QSL cards from stations worldwide. They broadcast on “established” pirate freqs (e.g. 6155 kHz) and are no danger to public safety.

Exactly, and it’s the frequency stuff they should focus on.

Then again I don't think you really want us old timers to drag out our 1500 watt Collins tube equipment and blow away 1/3 of the AM band while we have fun.....

Brute force.

It's much more fun to attack wireless mikes at public events. That way, you get to observe the results of your hack as you perpetrate it.

Who provided the infrastructure? Or did the ‘airwaves’ just pop up by themselves?

According to the Bible, God. According to Physics, the Big Bang.

UPDATE:

Pirate radio station Datz Hits 99.7 busted by FCC, including seizure of equipment. Caused problems not only to WCRB 99.5 classical (actually licensed to Lowell) in Boston area but AIRCRAFT frequencies. They were warned repeatedly and kept going back on. http://www.radio-info.com/news/fcc-has-seized-the-equipment-of-boston-pirate-datz-hits-radio-997
