My 12 year old daughter was visited by police today, what should I do?

Today my 12 year old daughter was in class when a student came in and asked her if she would come into the hall to talk to the police. When she went into the hallway a police officer explained that she needed to go to the principal's office with him and she then asked if she was in trouble. He gave her no reply. He asked her if she wanted to walk by herself so she wouldn't be seen with him and she said, "No, I don't care." When she finally arrived at the principal's office across campus there were four other officers present along with the assistant principal. The assistant principal had a letter written which was threatening to kill a fifth grader who was at another school across town. It said, "I'm going to kill you." Signed "My daughter, 7th Grader." The 5th grader claimed that my daughter was threatening her with notes on the bus.

My daughter does not ride a bus. My wife is a teacher and we live in another city. She rides to school with my wife. My daughter knows the little girl's older sister from church, and to my knowledge the older sister of the accuser is my daughter's friend. She spent the night at our house once.

These police officers proceeded to question her several several minutes. The school never contacted us. The police officer told my daughter to be sure and tell her mother about it.

Then my daughter had to RUN back across campus, all the time crying and knowing that people saw her with a police officer, THE ONE THEY ALL KNOW RUNS THE BULLYING PROGRAM AT THE SCHOOL.

My son is in 8th grade and heard that his sister "was in trouble with the police." My daughter's reputation has been ruined by someone who simply does not like her. This person chose to try to get her in trouble for that reason and that reason only. Isn't that bullying in itself? Can my daughter be questioned without a parent present?

Don’t forget to bring up the five officers. FIVE officers! That’s a little much even for questioning an adult. There’s many an adult who would later argue that they were intimidated into waiving their Miranda rights because they were surrounded by FIVE officers.

She didn’t write note. It was signed Deena T. 7th, which I assumed they went with the last intial and grade level.

They is solid red MS county. It went Bush in a big way. We have never had a reason to consider to homeschool and well my wife teaches first graders already.

Oh, by the way, my daughter’s princical goes to Sunday school with us. That should be interesting.

I would question the identity of the police officer.

What respectable law enforcement officer would have a child enter a classroom to ask another student to come out into a hallway to then be questioned by a policeman.

The next question would be to the school authorities. Why would they ask students to act as Kapos?

Agreed! Children should be provided with a representative when police question them in any case where charges could be filed. And, a minor child should never say anything other than their name and the names of their parents, period.

It is sad and this level of concern would not have existed prior to Columbine.

I'm glad none of my high school notes got published. I don't remember any threats, but there was a lot of silly (very serious at the time, of course) nonsense going on in my life, and I probably misspelled some of the anatomical terms.

My daughter is 80 pounds! Why does a 80 pound shy seventh grader warrant five uniformed armed police officers!

Get a good lawyer right away. It is highly likely that the police were maleficent in the investigation.

They should have confirmed the details of the charge before publicly taking her into custody.

The cops and the school officials are stupid and are now only thinking of covering their asses. You'll get no investigation now, unless you sue.

A jury will be really interested to hear how the cops explain how she harassed a student on a bus that your daughter never rode.

It is likely the school bus system has records of all the passengers, everyday. Use them

You need to go to the school and complain that your dauhter was the one being bullied and ask them to do something about it.

Yep.

It didnt take very long before severe enough issues arose with both of my youngest daughters and the School Systems Oh so brokenness, that it came clear that authority over my children needed to be taken back. If had to do it all again I would have acted much quicker and quite possibly not allowed our oldest to attend in this district either.

I’m more concerned for your daughter with that wacky 5th grader on the prawl. That note was violent. If the older sister of the accuser goes to your daugher’s church - does that 5th grader go there, also?

If I understand this right, seems like jealousy of your daughter and the accuser’s older sister’s friendship.

I agree with another poster here - say nothing but seek legal counsel. Most have free consultation - the problem is getting the right one. I think telling your son and daughter not to say anything for now is wise. The less said the better about your plans, etc. Does your wife teach at that school?

If I had kids in public school right now, I’d pull them all out and homeschool. Not a place for young impressionable minds. Homeschooled my youngest years ago and I have no regrets. The only regret is that I didn’t homeschool all my kids. Alpha Omega...excellent program.

Well, if it's unclear who wrote the letter and if it's unclear to whom the letter was directed, then it sounds like a dead end. I wouldn't worry about it.

Maybe you could write a note: "The letter was obviously not written by any of my children. I have taught my kids to never threaten people before killing them." :)

Does your wife know of any recent attention regarding procedures for handling bullying?

Somebody mentioned the possibility that somebody else wrote the note. It would be a pretty stupid 5th-grader who forged a note like that when the story could easily be disproven. I wonder if somebody else forged the note and this 5th-grader’s parents went to the school blazing mad, thinking the threat was real, and the school felt like they had to respond this way to avoid a lawsuit from the other direction.

In any case, the origin of the note needs to be investigated, and that should have been done much more discreetly than it was.

Obviously you should contact the police to make a complaint against whoever forged the threatening note. There’s a demented person out there who needs to be apprehended.

Since you know your daughter is innocent, you should drop your hostility to the police, who were only doing the minimum necessary to check out a threat of violence. You and yours are innocent, so act like it.
