This guy is going to be prosecuted for assault -- there's not much he can do. The only question is whether a jury will take pity on him.
However, the earlier reports indicate that he complained to his supervisor, who blew him off (and I think was even the originator of the taunt). He had grounds for a major sexual harassment lawsuit, but he may have blown his chances for a big settlement by taking matters into his own hands.
