While I sympathize with the landlord, he does not have a right to deface the un-defaced house he contracted to rent them. They have a cause of action against him, though they might not be the most agreeable plaintiffs, and may face an offset against unpaid rent.

Let me assure you that as far as rental property is concerned you don't have much in the way of private property rights. The tenants know that courts are reluctant to evict and slow to hear cases. Most renters can get four or five months with out paying rent before being evicted. They will finally move out the night before the Sheriffs come to evict them.

Even if they do get thrown out you must hold whatever personal belongings they leave behind in storage for 6 weeks. I had someone show up after 4 months wanting their stuff.

Rental property is ok if you get decent people but it is simply impossible to tell in advance who is going to be good. I have had the same people in a few houses for many years but others you know are going to have to be evicted before the end of the first year.

A bad tenant can eat up a years worth of rent in just fixing up the house after they leave.
