I just think that getting a DUI for being on a lawnmower, bicycle or other slow moving device is kind of over the top.

I think you are right but most state laws prohibit operation of any motor vehicle.

The power of MADD, greedy local officials, and stupid people. Those groups team up to prevent any sort of sanity in the law. If a politician were to object to such a law, he or she would be branded a heartless baby killer who wanted people to die on the roads. *poof* The end of one political career.

It’s the same for smoking. A similar kind of effort was put into demonizing smoking. I smoke 3-4 cigars a week, only outside. I can’t tell you the number of times I’ve gotten dirty looks, and saw women acting as if my second hand smoke would surely be the death of them.

I think the WV Supreme Court recently held that a riding mower is not a motor vehicle under state law. No authority in TN, but I would try it out as an argument if I were his lawyer.
