“We need to tread carefully in this area, because we would be changing, frankly, settled law,” Cornyn said. But “it’s certainly within the power of Congress to do it” either by statute or by amending the Constitution.

Legislation pending in the House would restrict automatic citizenship to children with at least one parent who is an American citizen or lawful permanent alien living in the United States. The bill has 94 co-sponsors, including 15 of 20 Texas Republicans in the House. Currently, a child born in the U.S. is automatically a citizen, regardless of the parents’ status.
