My girl friend need helps. But I don't know how to help her. her brother (35 yo) got a ticket for "unlawful posession of illegal fireworks" on Jul 4. he went to the court , the judge told him to get a lawyer (his income is a little bit too high to get a public defender). it costs $2000 for lawyer. it's rediculous to spend $2000 for having fun with fireworks on Jul 4. the lawyer said, he can pledge on his own at court, but if what ever he says do not make sense, he will go jail for 90 days plus a big fine. it's the first time he got a silly ticket like that . I would appreciate if any one could give me an idea.

Talk to the village/state attorney and find out what he’s looking at in regards to a fine. I had a case once where I pled guilty and figured I’d just pay the fine. The judge told me that if I would do public service time he would dismiss the ticket. I did the public service.
The “reason” for the law to prohibit fireworks is the same as the drinking age or the speed limit. It’s a legal line, but enforcement is expected to be circumstantial.
Some 13 year olds shotting bottle rockets at each other is different from a responsible adult with adequate property and who takes precautions.
Both are completely illegal in many states, but the former is much more likely to generate police action.

let me tell you, he came to a lawyer, the lawyer said if he hired her (lawyer) now, she will charge $1500 for this case.
if he represents by himself. things get worse., then come back to her, it would be more than $1500 !
she said he could be in jail for about 30 -or 90 days for shooting illegal fireworks.

The thread was an interesting read. Firecrackers are supposed to be legal here in AZ after 7/29, but I’m sure every city in the state will make them illegal instantly.

That is not my experience. I've lived in rural areas where there is zero chance of mishap involving property or livestock, and firecrackers were illegal.
We might disregard the law but we never “forget” what it is.

I don’t think you understand the situation. A person committed a crime (illegal fireworks) and wanted to get away with it. Instead, the person should OBEY the law, and work to get it changed. You don’t get a law changed by VIOLATING it. What I was showing was that people try to JUSTIFY their actions instead of accepting the punishment when caught.
Stupidity (reaction to a childs hug, bringing an obvious toy gun, drawing a gun, or even a picture of an Army man) is inevitable when you allow feelings to overrule common sense, as in these cases.
And yes, I am conservative. (I think Rush is a flaming liberal :>)
