Just now, got a ticket when I and all my passengers had seat belts on.
I had a gray shirt and a gray seat belt. The Cop insists that he saw it hanging down.
Everyone in my car knows I was wearing a seat belt but they are all minors.
I will go to court and fight this, but what the heck.
this happened to me a few years ago. One officer stuck his hands inside my sunroof and his partner insisted I turn off the car, which automatically closes the roof. I insisted he remove his hand or the roof will close on it and he kept in in there. I turned off the car, his hand got caught in the roof and he wanted to charge me with assault.
Some people have no business working in the real world which is why they get govt jobs.
Fight it. The officers failure to see something is a weak argument.
Fight it. Fnn cops are just trying to be good field revenue collectors. My buddy has fought 3 of them so far and the cops are always a no show. More revenue to collect out in the field verses 1 person in court.
Hmmmm
I guarantee you’ll sell one to somebody who crashes and blames you for their injuries.
The guy was in his car about 32-45 feet away in his car.
My Wife took a picture standing 16ft away, and you can’t tell, and she isn’t in another car.
I have the pictures, and no, I am not going to post them.
Unless this guy has xray vision, he didn’t see jack.
In America’s traffic copurts you are guilty until you can prove yourself innocent. It is one stage of American justice where they always take the cops word.
Power
Yes I know, that is why I am considering not bringing my kids into this.
Odd, it seems that a brownshirt would be just the *cough* ticket in his world.
I have a more limited belief in "coincidence" now than a few years ago.
Hey, are those the same illegals that stole my bikes?!? Had three different bikes stolen, one time it was locked, and the other time it was in my garage. Cops didn’t do a thing.
He didn’t do anything either, but I got my bike back because I tracked it down.
Hehehe.....
I got one of mine back because I heard through the grape vine who had it, and I went and got it. The guy spray painted the entire thing blue, but he didn’t file off the serial number...idiot. The other two are gone for good. It’s kind of infuriating that I even have to worry about if my bike will get stolen, or whether my house will get broken into, etc...What happened to this country?
Seat belt usage will NEVER be the primary reason for enforcement stops.
Oh, wait........
What’s wrong with these laws is that they are absurd, and need to be repealed. It’s all caused by the federal government meddling in things over which they have no legitimate authority.
Bring the pictures and if at all possible the picture taker as a witness to the place, time of day, weather conditions, and distances. Make sure the pictures are numbered and have these details noted on the reverse with the signature of the picture taker.
In court, you want to have the picture taker available to testify as to how the pictures match the conditions at the place and time of the ticket.
Your point is to show that the officer, from where he was, could easily have been mistaken as to what he saw. If the officer shows and takes the stand, try to get him to admit that, in the circumstances, he might possibly have been mistaken in the brief moment that he had to assess whether you were wearing your seat belt.
If the officer is a fool, he will insist that he could not have been mistaken. The most that he can honestly say is that he does not believe he made a mistake.
In addition, bring your minor witnesses. They can usually testify if over the age of seven or eight. You should be ready with a short and simple written list of questions that you want to ask them. You might offer or ask that the judge pose the questions in order to give a greater assurance that the children are speaking truthfully.
The key point is that with minor children aboard, as a standard practice, you insist that the children wear their seat belts -- and you always do so as well to set a good example.
Fight the good fight! I see you received lots of excellent advise and feel confident you will prevail.
I guess I am going to have to have my seat belt metal coated with reflective paint. Maybe I need to make it construction orange.
My kids missed school because of this, I had to take them home.
