Many Americans said No! to ObamaCare in polls and recent elections from Virginia to New Jersey to Massachusetts. But, now it has passed. The majority of citizens still want it repealed. The anger and frustrations are unlikely to subside as some politicians are hoping. ObamaCare is now the law of the land. That may change with the pending constitutional challenges, but the time has come to plan ahead and prepare for a very different future. Americans are law-abiding, so individuals and businesses must consider what this legislation means, discover what options they have, and what actions are required under the law. Employers have two major needs. First, senior management must be alert to the many changes that are still likely to happen that may alter their strategic benefit planning. Second, benefit managers need to know what to do tactically today and tomorrow in order to prepare for the next open enrollment
It will be hard to create a multi-year strategic plan. There are too many uncertainties. The legislation, developing regulations, and interpretations of the law will take years to write, understand, clarify, and litigate. Aspects of the law start in 2010 and go through 2018 and beyond. The tactical day to day work efforts by benefit managers will be defined by senior managements strategic decisions and a focus on the effective dates for the various initiatives as set by the law.
For flexible strategic planning, there are four major phases to consider: Legislation, regulation, compliance, and litigation.

Therefore, a firm promise to refund these taxes when the votes are there for outright repeal needs to be a part of any strategy to defund.
But I can see possible civil disobedience. Lots of Americans are mad and aren't just going to roll over and take it.

Any federal version of health care is unconstitutional. The people are not bound by an unconstitutional act. The people are the government, not Congress, the White House or SCOTUS. They operate at the consent of the governed. The people will have the final say as to how they are governed. Clearly the people do not consent to the socialist, tyrannical, runaway government that is attempting to destroy the Constitution.
