I'm going to have to take exception to you on this one. This was an act of Theft by Conversion and a very serious offense. There are no "free speech" issues here. There may be other serious charges involved, but this was the first that came to mind.

conversion n. a civil wrong (tort) in which one converts another's property to his/her own use, which is a fancy way of saying "steals." Conversion includes treating another's goods as one's own, holding onto such property which accidentally comes into the convertor's (taker's) hands, or purposely giving the impression the assets belong to him/her. This gives the true owner the right to sue for his/her own property or the value and loss of use of it, as well as going to law enforcement authorities since conversion usually includes the crime of theft.

Years ago when I was beginning my engineering career I was involved in something similar. We had installed monitoring equipment on a utility ROW. The following morning the (very expensive) instruments were gone. The landowner took exception to them being left on "his" property. The Sheriff had a totally different take on it. They were hand delivered back to us with an apology. We did not press charges, however the authorities had advised us to.

and you mr knowitall has expertise in every field in the universe? You’re being rather smarmy with your “friends” to call them stupid because they consider a computer just another appliance like a dishwasher or a fridge. I’ll tell you who is stupid and that is the company called Microsoft...

"F___ Apple!"

"Grow up!"

"WE all know what is happening here."

~~~~~~~~~~
No, thanks. There are very few here on FR who would aspire to 'grow' "up" to your third-grade level of gutter discourse.
And again...
Police seize gear from Gizmodo iPhone blogger
A computer-crime task force made up of multiple law enforcement agencies searched Gizmodo editor and blogger Jason Chen's house and car in Fremont, Calif., on Friday, according to a statement and search warrant documents provided by Gizmodo.
The warrant, issued by a Superior Court judge in San Mateo County, said the computers and other devices may have been used to commit a felony. Steve Wagstaffe, spokesman for the San Mateo County District Attorney's office, confirmed the warrant's authenticity.
Members of the Rapid Enforcement Allied Computer Team took several computers, hard drives, digital cameras, cell phones and other gadgets, plus Chen's American Express bill and copies of his checks.
There was no legal, perhaps an ethical, obligation
And yet they can't find a single illegal alien to harass.
overpriced crap made by Apple.
And yet they sell products that people want to buy, without a single bailout, or even massive layoffs.
They’re also probably seeking the identity of the gentleman who sold the iPhone to Gizmodo.
Gee, what if it turns out it was the guy who claimed to have lost it?
“The prototype iPhone in question may have been found OR it may have been stolen...”
.
Or more likely, it was planted for the sake of publicity and public interest.
Yes, indeed, and their sales keep increasing even during a Depression, what a deal! :-)
Look at this -- even during our very dour financial circumstances, Apple keeps doing very well with their wildly successful products that they design, make and sell to the average consumer in this country (and other countries, too...).
Thanks mostly to the iPhone, Apple's cash and investments rose to about $42 billion as of March 31, nearly three-quarters of the tech company's total assets. In six months' time that figure could approach $50 billion, given Barclays Capital analyst Ben Reitzes's estimate that Apple will generate $14.6 billion in free cash flow this fiscal year.
As a banker, though, Apple Chief Executive Steve Jobs is no Jamie Dimon. Invested heavily in government and corporate securities and commercial paper, based on past disclosures, the money earned an average yield of 0.75% in the December quarter. Apple hasn't disclosed the March-quarter yield.
“For that matter, how do I know Apple didn’t have the employee “lose” the prototype on purpose to provide publicity worth millions of dollars?”
.
I think that those of us with IQs above the melting point of H2O can agree that this is the most likely scenario.
This was obvious from the first moment. The “loss” was so unlikely as to be dismissed at first glance.
As you can tell from the other poster, "editor-surveyor", when he said ...
Yes, altar boy.
... there is no reason or rationale or sense to anyone who is a Mac-hater, Apple hater, and one of those of the "nattering nabobs of negativity"...
It doesn't matter whether someone killed an Apple employee (if such a thing did happen) -- they would be one of those who would say that it's one less Apple person to be concerned with ... doncha know ... LOL ..
They don't think in terms of laws or who did what, or whether a crime was committed -- they just think in terms of their own irrational hatred of a company (for reasons that only make sense to themselves).
There's no fixing someone's mentality who is like that... only the asylum is there for them as a resting place to hopefully ease their minds, with the help of some psychiatric drugs ... :-)
It’s really not stupidity, It’s more like a lack of common sense.
I have never ran an Anti-Virus Bloatware program on any of my PC’s and the only times i have ever caught a virus is when i let some idiot use my computer.
I would then be forced to use some more common sense to rid my PC of said virus.
Those are the type of people that rant and rave about their Macs, because they can’t handle the awesome “Complexities” of a PC.
Whatever, i like the freedom to watch, listen, and play whatever i want on my PC without My big Brother Steve Jobs telling me what i can buy and use.
I also like the idea of being able to upgrade my PC whenever the urge arises without having to fork out another 3 Grand for a new apple.
Well, that's not something to be too concerned about coming from someone who is as irrational as you, about Apple/Jobs/Macintosh and foaming at the mouth about all things Apple ... LOL ...
I don’t suppose that you can engage your little mind enough to deliver some evidence of that juvenile assertion?
You were saying ...
I have never ran an Anti-Virus Bloatware program on any of my PC’s and the only times i have ever caught a virus is when i let some idiot use my computer.
I've actually tried to get any Windows user to run their computer on the Internet, use it for web browsing and downloading and all their normal and everyday stuff that they do with the computer (basically for all the stuff that they do with a computer) -- for a year -- and run that Windows machine without any anti-virus program, direct on the Internet and not behind a firewall.
I say all that, because that's pretty much what a large majority of Macintosh users do with their computers -- run without any anti-virus program, not behind a firewall, running it direct on the Internet, do their web browsing, downloads and/or e-mail and all the normal stuff -- and never have any problems at all with viruses and/or other kinds of malware.
In fact, a number of anti-virus software companies are trying their darndest to get Macintosh people to use anti-virus software, but they just can't get them to do it, because they just don't get those viruses, doncha know...
So, I think that's why a lot of your "average Joes" and the normal consumer loves their Macintosh when they get a hold of one and never have to worry about those things like the Windows people have to.
You've done enough foaming at the mouth for me... for one day... LOL ... I'm still trying to get it off my screen since it's leaked over from your posts ... :-)
