Question about the proposed immigration law in Airzona

Arizona has proposed a law, giving law enforcement the authority to stop anyone they suspect as "illegal".

Now you can look silly and try to deny it, but we all know this is nothing more than government sanctioned racial profiling. Its a green light for cops to stop anyone who who appears foreign or more specifically Hispanic.

We already have enough problems in this country with law enforcement conducting searches absent probable cause in the name of the almighty War on Some Drugs. Frisking and searching people because they might be armed, not that the cop saw something he/she can articulate as a possible weapon, but they might have, could have been armed. The USSC just smacked LE again, because they continue to think they can search anyone and everyone in a car simply because they were in the car when it was stopped for a tag light violation. The just ruled (again) that passenger are not required to give officers ID during a traffic stop. The third time such a ruling as been handed down.

It seems that cops are already very capable of violating our constitutional rights without the tacit permission of the state of Arizona.

So why in the hell are conservatives so eager to embrace the this constitutional violation while calling for the heads of anyone who even dare attempt to enact any type of gun restriction. Even if that restriction is in the name of public safety or the safety of law enforcement.

This is a dangerous and slippery slope in this country.

I agree that illegal immigration is a problem, so is crime committed by illegal immigrants.

But so is crime committed by our citizens too. In fact to a much larger and greater extent that all crimes committed by hispanics combined.

This will be found unconstitutional, mark my words.

It wreaks of some of the laws and decrees passed by the Nazis during the 1930's.

Whats next our very own Night and Fog Decree?

Come on folks wake up and stop missing the forrest for the trees. GIving the police what amounts to carte blanche to stop anyone and everyone because they look like they might be illegal is a nightmare waiting to happen.

Between this and the new software program that IMB is working on, Criminal Prediction Software what the hell is happening to this country??!?!

And I'm shocked at the number of people who call themselves conservatives who support such draconian laws promoting constitutional violations1

You seem to be confused.

In the case of illegal aliens, a crime has ALREADY been committed. Spanish speaking Latinos are not being stopped and questioned because they are “likely” to commit a future crime. A crime has ALREADY been committed and the police are questioning the people who fit the descriptions of the perpetrators.

In the case of illegal aliens, a crime has ALREADY been committed.

American courts have ruled that the act of being an illegal alien is not a crime in itself.

With that it is going to be difficult to establish probable cause of a crime based simply on how someone looks.

This Arizona law is brand new. It makes being present in the State illegally a crime entirely separate from any Federal laws.

No “American court” has ruled on it, so it must be considered the law of the land unless/until it is struck down. So the burden of probable cause of a crime being committed is easily met.

Not the best logic you use there, Bucko. The fact that those crossing the Southern border are brown doesn't make it racial profiling. It's simply a fact of life.

Nor does that mean that anyone who insists on a secure border is racially motivated. It means we want America as secure as possible.

Nor does it mean that we're opposed to immigration. We're opposed to illegal immigration and the drain it imposes on our economy and job growth.

Go back to the drawing board. You need to rethink this.

The Arizona budget deficit is $1.5 billion.

That whole “racial profiling” stick was introduced by the CPUSA to further inhibit proper police procedures. It is pure BS. If a cop is in a hispanic barrio, and someone is shot to death, who are you going to look for? A Russian? A German? A Swede?

You sound like you would be happier at RINO USA! I never heard anyone but a left winger use that term!

I notice how The Magical Mischief Tour complains about the effort of Arizona lawmakers to deal with illegal immigration, but offers no positive ideas on his own behalf. Typical of left-wing apologists and naysayers.

The simple fact is, illegal immigration is a major problem in our society today. And it’s compounded by the fact that Mexico is willingly allowing communists and anti-American insurgents to infiltrate our country, and manipulate our elected officials. The two issues are now inseparably entwined.

So, how do we deal with it? Arizona has taken control of their state through this legislation. Let’s hope the governor signs it into law. Is it profiling? No. Those crossing the border illegally are mostly of one race, don’t speak English well, and don’t have proper identification. That’s not racial profiling but target profiling; the same as when an officer is looking for a perp described by witnesses.

If an officer stops a Black man who fits a description but isn’t the offender, is that racial profiling? No. He’s doing his job, and can expect such errors at times. The same holds true in this case.

This racial canard is a staw dog, as you say, coming from the CPUSA. It’s being used against us, and there are those among us who let their emotions get in front of their logic. It’s they who are being manipulated, and they who are advancing this destruction of our country and way of life. I, for one, will not allow it to happen.

Not that difficult. Using reasonable suspicion to conduct a lawful stop(reasonable suspicion requires less proof than probable cause) someone can be pulled over for as little as weaving in their lane or a license plate bulb burned out.

As long as a valid reason can be articulated.. the next question is “license and insurance please”...if you don’t have that or it looks fake, they would have likely have probable cause to ask citizen status. Reasonable suspicion often leads to probable cause.( Kind of like a “Terry frisk” leading to discovery of a gun leading to a felony arrest for felon in possession of a gun.) Or “in plain view” leading to a drug arrest from a simple speeding stop.

This aside, what’s the problem with states enacting their own laws?

IMHO,comparing illegal aliens who are committing a crime to holocaust victims is ludicrously trashy.

You sneak into my house by the back door and you've committed a crime, despite what some knuckleheaded judge has said.

That's the crux of this issue.

Why don't you come on down to visit me for a few days. I think it would be an eye-opener for you.

My view is simply that this law will not stand when it goes before a federal court.

At which point the Federal Government admits it's their job to prevent illegal immigration in Arizona, and we can expect them to pay what they owe to us for the cost of incarcerating illegals at a minimum. Then, we'll talk about the costs of health care and education.
