1. As part of marrying Tiger Woods, Elin entered into a prenuptial agreement with him.
2. The prenuptial agreement sets forth the amount of money Elin would receive in the event of a divorce.
3. Infidelity is one of the leading causes of divorce.
4. Therefore, it was conceivable at the time she signed the prenuptial agreement that Elin and Tiger would divorce and that the reason would be infidelity.
5. Now she demands to be allowed out of her contract in order receive hundreds of millions of dollars, instead of merely tens of millions of dollars.
I don't condone Tiger's behavior. I have sympathy for her as a cheated-upon spouse. And I agree with Brit Hume as to what Tiger should be doing.
Having said that, I see no reason why Elin should not be bound by the contract she signed which contemplated the circumstances she now finds herself in.
He broke the marriage contract. All bets are off.
Just the opposite from "all bets are off". The prenuptial contract is the contract that comes into play when the marriage contract is broken.
I don't understand all of the support for Elin to break the prenuptial agreement (other than an understandable knee-jerk emotional response).
She and Tiger freely entered into the prenuptial agreement. It says how much money she gets if they divorce. I assume, like most prenuptial contracts, it applies regardless of whether Elin's behavior is at fault or Tiger's behavior is at fault for the divorce.
In a free country, shouldn't this agreement freely entered into by these two people governing this very circumstance be respected? Why should a judge get to decide that the contract does not apply, and take from him half of his fortune, which is not what is provided in the prenuptial agreement for this circumstance?
If people feel a court should be entitled to take away Tiger's fortune even in the face of an agreement that she signed that says otherwise, isn't the honest thing just to make adultery a crime? Then at least the penalty (half his fortune) could be honestly tied to at least having committed a crime.
Having been the wife of an adulterous husband, I can tell you it's the most demeaning and humiliating situation for the wife. Personnaly, I hope she takes him to the cleaners. He can make plenty more and run around all he wants after the divorce.
This situation hits close to home for many people.
If there is a clause in the prenuptial agreement providing for the result in the specific case of Tiger’s infidelity, then her argument to void the contract becomes even weaker.
While faithfulness and family values are conservative principles, I just don’t want another conservative principle at work in this case to be overlooked - the sanctity of contract, the right of people to freely enter into agreements with each other, and the right to be free from arbitrary takings of property by government courts contrary to a freely-entered into agreement.
No-fault divorce has already destroyed the sanctity of the marriage contract.

Well, I’d prefer to read the contract before reaching that conclusion. But in any case, courts often don’t interpret contracts in the way we laymen are inclined to interpret them.
