Yes, that was said. But Judge Carter’s comments about wanting to rule “on the merits” was in reference to the dismissal. Not that there will be a trial. He didn’t want to dismiss a case when both parties were right in front of him. So he allowed Orly to properly serve the US Attorney. They now have 60 days to respond.
They were first snickering at Orly Taitz, but now they are “eating crow.” Judge Carter said-

2. It will be heard on the merits.
3. Nothing will be dismissed on proceedural issues.
4. The trial will be expeditious, and the judge pledged to give case priority.
