Good Samaritan Gets Ticketed After Saving Lives.

DENVER – A good Samaritan who helped push three people out of the path of a pickup truck before being struck and injured has gotten a strange reward for his good deed: A jaywalking ticket. Family members said 58-year-old bus driver Jim Moffett and another man were helping two elderly women cross a busy Denver street in a snowstorm when he was hit Friday night. Moffett suffered bleeding in the brain, broken bones, a dislocated shoulder and a possible ruptured spleen. He was in serious but stable condition Wednesday. The Colorado State Patrol issued the citation. Trooper Ryan Sullivan said that despite Moffett's intentions, jaywalking contributed to the accident. Moffett had been driving his bus when the two women got off. In the interest of safety, he got out and, together with another passenger, helped the ladies cross. Moffett's stepson, Ken McDonald, said the driver of the pickup plowed into his stepfather, but not before Moffett pushed the two women out of the way. When he awoke in intensive care, he learned of the ticket. "His reaction was dazed and confused. I was a little angry," said McDonald. The other man also was cited for jaywalking, while the pickup driver was cited with careless driving that led to injury. Sullivan said the two elderly women haven't been cited but the investigation is ongoing.

It’s a way to document relative responsibility in the “coming lawsuits” that will surely proceed from this. It’s simply a “factual” matter... no matter if he was saving lives.

You can imagine that insurance companies are going to be asked to “pay off hospital bills” in the case...

I'm sure they'll be cited for something because if they didn't get off the bus then the accident wouldn't have happened.

In these kinds of cases where there are multiple reasons why an accident happens, it turns out that the various parties are assigned “relative responsibility” in terms of whatever costs are determined by the courts.

So, in that kind of situation, it would be the *responsibility* of the officer to document and assign the various “infractions” that contributed to the accident.

From that, the courts will determine how much each party is responsible and for what part...

Maybe the two eldery women should be cited for reckless stupidity.

There is a reason they have crosswalks and stoplights. Ever had to slam on your brakes in traffic to avoid hitting a pedestrian who decided it was too much trouble to walk to the corner to cross, but instead decided to cross in the middle of traffic?

The driver that struck these women was not at fault, but I gurantee you that as soon as these women were struck there was some ambulence chasing lawyer making plans to sue him for everything he is worth. It may seem heartless, but it needs to be documented that these two women and the bus driver put themselves in harm’s way, if for no other reason than to protect the innocent car driver from the lawyer.

How do you think John Edwards made his money?

This has nothing to do with Obama. It’s something that has been in effect for a very long time. It’s been common to assign relative responsibility for accidents and to use the data (as to infractions and where someone did something wrong) for the courts to determine where the relative responsibility lies.

While there are plenty of things that one can attribute to Obama and fight against them — this is not one of them...

1) He is a 'bus driver', could it be for the locality? If he gets hit with a ticket, the locality may be able to benefit by not getting sued.
2) Good Samaritans reward nobody - better to assign guilt to everyone so that the lawyer lobby can choose the best value.

What I dislike the most is the habit of some jaywalkers to walk out into the street without even looking to see if a car is coming. A couple of months ago I was driving along a poorly-lit road late at night in an area where you almost never seen any pedestrians, when young black woman wearing dark clothing decided to walk across a four-lane highway (50 to 75 yards from the nearest intersection), 40 mph speed limit area. Because of oncoming headlights I almost didn’t see her. She was probably oblivious to the fact that she was endangering her own life.
