A 37-year-old Boise man was arrested and charged with felony aggravated assault after he drew a pellet gun on a man who happened to be carrying a real pistol. Damon Glenn Smith was also charged with felony DUI and misdemeanor resisting arrest after the incident at 11:48 p.m. Wednesday at Table Rock, a popular sightseeing spot overlooking Boise.

Matthew Pond, 19, said that as he and two of his friends drove up to the mesa for the view, they passed a truck that was trying to go off-road. When they reached the top, the truck pulled up behind them and the driver - later identified as Smith - started yelling at Pond. "I could tell (Smith) was extremely intoxicated so I just tried to talk, to tell him there was no problem," Pond said. "That was when he said 'Do you want a problem?' and pulled out the gun."

But Pond had a weapon, too - which police say was displayed legally. Pond said he got out of his car and backed away slowly as Smith got out of the truck. Pond said he did not pull out his own pistol as he tried to defuse the situation. Smith repeatedly pointed the gun at Pond and his two friends before he finally put the pistol in the back of his pants and started yelling at one of Pond's friends, Pond said. Pond then approached Smith and put his hand on Smith's gun while pulling his own at the same time.

No no no, he’s a dangerous bundle of hormones that could explode at any moment and should be arrested when he returns to his college campus to ensure the entire all students remain disarmed!

Smith got into his truck and drove away, and Pond called 911. But Smith came back and began arguing again and asking for his gun back. He tried to leave again as the police showed up.

37 year old Damon Glenn Smith is a major league asshat.
19 year old Matthew Pond is one level headed young man.

Idahoans are tough all right.

My dad was born and raised in American Falls, went to Law School at Moscow, Idaho, and I spent many years in North Idaho, and I can tell you from personal experience...Idahoans are tough!

Matthew Pond is an avid Open Carry proponent here in the Boise area. Goes by "Saint" at the Open Carry forums.

Here is the original thread over at opencarry.org before it broke news:

GUN PULLED ON ME TONIGHT!
