Again, this is outrageous. People are actually upholding the idea that a secretary of state has veto power over a senate appointment.
Yep, that’s it. George Wallace changed, change that really mattered. Doubt that Reid ever will.

Now that's out of the way. I believe the appointment by the Governor has a check and balance system that was not completed by an attorney general. I may be wrong. But I am not sure he has to be legally seated as I understand it.

fox was saying this morning that burris’ paperwork did not have the IL sec. of state seal on them and therefore were not valid for admission.
U.S. Constitution Article I Section 5. is specific that each house has sole authority of whom will be admitted and etc.

That certainly is not an absolute to allow Harry and his Dem goons, to unilaterally reject a “qualified” appointee as prescribed by Illinois law. He is an appointee, so qualifications (per the Constitution) are the only issue at hand and the Senate has done nothing to demonstrate that a valid appointee is not qualified. This is all purely political revenge by Harry (et al) against a corrupt thug governor they don’t want any association with....kinda hypocritical for the Dems, ain’t it ??
Actually, until such time as the Illinois Secretary of State has certified Burris’ appointment by Blagojevich the appointment is not official and Reid is justified at law in doing this.
The Governor has the legal authority (the only legal authority) to appoint a Senator. The Illinois Secretary of State can not reject the appointment, he can only certify that the person named is the person appointed by the Governor.
The Senate has no authority to reject a qualified Senator selected in accordance with State law.
Legally, Burris is the junior Senator from Illinois. Technically, he is only a mandamus action away from forcing the Secretary of State to do his job and certify the appointment from taking his seat.

Tenacious.. Here’s the problem Harry and Dims have..
Blago has not been impeached yet. So..as such, he still has legal authority to appoint a replacement for the seat.
The Illinois Sec of State then has to “certify” that Burris is the duly appointed individual to fill the seat.
The certification is basically a formality..the Sec of State in IL has no authority to simply refuse to certify Burris’s appointment because he wants to.
There is nothing in Illinois law that prohibits a governor from executing his duties as governor if under criminal charge or indictment.
This will go to court..and the courts will likely rule that White MUST certify the appointment..and then Dingy Harry is going to be put in a REAL pickle...because they could try again to block him from being seated..
If that happens again, they have no cover to hide behind like they do now since Burris does not have the certification document
I don’t want to even consider that this is some sort of racial bias on Sen. Reid’s part. I really hope it is some sort of concern over the tainted appointment if he seats Mr. Burris, but if Henry asks Burris how many bubbles there are in a bar of soap, I’m going to have to reverse myself and take exception.

If ole’ dingy harry is so into following the paperwork trail, then I certainly think that he will do the same and demand that obama’s birth certificate be authenticated.
