Negligence is negligence. Unless he intentionally shot the guy, which is even worse.

Is BART named after Bart Simpson?" Just askin'.

The single most damning piece evidence against the police officer appears to be on this video clip - http://mfile.akamai.com/12948/wmv/vod.ibsys.com/2009/0105/18415632.200k.asx

Though it still isn't clear whether he had actually thought he was firing his taser.

The bullet went through the guy's lower back, ricocheted off the pavement, and then passed through his upper chest.

After watching the video I’ve got no better idea what happened than before. It so chaotic and jerky it’s impossible to tell what’s going on.

Did you read the article? He had been tasered already was CUFFED and laying on the ground. I do not give a damn who you are or what you did you do not get executed when bound and laying on the ground in this country. I hope Burris sues the $hit out of BART and the officer.

That clip is clearer. You can at least see a cop drawing his weapon and holstering it again.

One less thug on the streets, though at a steep price if the ambulance chaser has his way.

Wow. No judge, no jury, just an on-the-spot police bullet in the back, eh? Quite the American way.

How many murders were committed last year in Oakland by thugs like the saintly boy “turning his life around” who was executed by the fascist police? “No judge, no jury.” Where were you protesting? Answer these two questions, if you please, comrade. Yes, hypocrisy is the American way, indeed.

The cops not acting like assholes and executing nonthreatening innocents? Or is that too much to ask?

Don't know. What, if anything, does that have to do with this case?

Or, are you arguing that because criminals kill others without due process of law, cops should be allowed to do the same?

How many murders were committed by THIS kid? That is the appropriate question, not your, “well he looks like all the other thugs so he deserved what he got.”

Perhaps in whatever country you live in (given that you say gas is still hovering at $5 a gallon, I know you are not in the USA), that is the type of justice system you favor. We do it a little differently here in the US of A. Try it some time. You might like it.

I am not indicting all police, so your comment about ‘fascist’ police is stupid and meaningless. You might throw a child off your trail with such silliness, but only just so.

Spare me your outrage and predictable responses. This thug, living in Oakland, had a small chance of suriving past 30, given his willingness to start arguments and the crime situation in that city. No one of the Internet Church Ladies would have missed him, just as no humorless Church Lady who can’t get a joke about $5 gasoline, misses the cops murdered on the street of our peaceful cities. Live by the sword and...

LOL. You don’t even have a point to make anymore, do ya? Of course, that presumes that you had one to make in the beginning, something I’ve yet to see evidence of.

whether the officer had meant to fire his Taser stun gun rather than his gun

BART rent-a-kops don't know the difference between a Taser and a firearm??

You think the BART rent-a-kop will actually end up in prison? I'm not that optimistic.

Probably will. It looks like a gross mishandling of the situation, even discounting the lies from the notorious Oakland ambulance chaser and the victim’s buddies. (I haven’t and won’t watch the vidoeos.)
