Police find Oakland boy's stash of seven loaded weapons

OAKLAND — After a 13-year-old boy threatened the lives of school staff members Thursday morning, police searched the boy's home and found seven loaded guns near his bedroom, school officials and police said today.

Police confiscated the weapons, which included two rifles and a shotgun, and took the boy into custody on suspicion of making terrorist threats and threats to a public employee with intent to cause deadly or bodily harm.

The boy attended Oakland Community Day School, an alternative school in the hills for middle and high school children who have been expelled. On Thursday morning, he appeared distraught, complained that he was being harassed, and made threats to a case manager, said district spokesman Troy Flint. The employee immediately told the school principal, who called the police.

This “school” is a special institution for bad apples. This is not the typical Oakland public school.

Not to sound like I am defending public shooling, especially in Oakland. But I had to read it twice to get that this type of student is already under a microscope for past discretions.

Near, as in his parent's bedroom, or in a gun safe? How many children go out and purchase rifles and shotguns? Any farm child could open his mouth and make a fool out of himself - and then the police could search the farm and find plenty of rifles and shotguns used solely for hunting and varmit control.

The question I would first ask is "Does this child have access to the weapons and the ammo?" Then, if the answer is yes ... punish the parents for raising a butt-stupid kid.

Geez, I thought anything over two guns was an “arsenal” in a “compound”. ;-)

Excerpt from California Penal Code Section 12020:

It is unlawful to store a loaded firearm where the person knows or reasonably should know that a juvenile under 16 is likely to gain access to the firearm without the permission of the juvenile’s parent or legal guardian...

If the guns were loaded and they were stored somewhere that he could gain access to them, then his parent or legal guardian is screwed.

Likewise, if a juvenile broke into my home, stole my guns and it was determined that they were not secured with a state approved locking device I could face criminal charges.

Flint said the boy cooperated fully with the authorities during Thursday's investigation. He said police were told that the weapons once had belonged to an uncle who is no longer alive.

The question is how did the boy come in to possession of his dead uncle’s guns and why did his parents not know about it?

If his parents knew about the guns why were they not controlling his access to the guns?
