escapees don’t stay in the jail and come back to their cells on a regular basis. In most systems you get administrative discipline or increased time, but it’s not a felony.

The Bloomfield Daily World newspaper reported that the sheriff was glad the inmates were not able to gain access outside the jail. “We’re going to have to find a way to have a better security system,” he said. It's called paying a guard to WALK the floor rather than sit on his butt watching a security camera when he's not busy selling inmates contraband cigarettes.

A good lawyer would have fun with this.
He could argue that since they never left the jail and had no plans to leave the jail that they were not, in fact, trying to escape.
In fact, I believe their are precedents that would back him up.
