Right off the bat, if there's any sense in the legal system (yes, I realize that's just silly) this case should be thrown out... It's sort of like GM suing Toyota, because only Toyota makes "Toyotas," and is therefore, a monopoly.

Actually no, it would be like GM selling parts that a small car company buys and puts in their car then GM saying *you can only put a GM part in a licensed GM car..
