Please pray for my wife and me
March 15, 2008 | Self

Posted on 03/15/2008 1:40:52 PM PDT by jmaroneps37

My wife is a teacher who was injured in the line of duty. Now the local Bd of Ed wants her to prove her case beyond what has already been done, but we don't have more to give them. We have witness statements. We have the principal's support. We have doctor's notes. If we can't straighten this out by Wednesday they will stop paying her and take her benefits.

Almighty Father, I humbly ask You to deliver swift justice for these folks, as is Your will, for You know all. I ask this in Jesus’ Holy Name, Amen.

I have been thinking about this constantly since the letter came yesterday. I slept about an hour then dreamed of it.
I know we are right. It comes down to three questions: Did it happen? - we have a witness and the principal is with us. Did she actually get hurt? We have been to some many doctors I honestly can't remember all of the visits. She has C4-5 damage which has resulted in her inability to raise her head or her arms above horizontal.
Did the incident cause the damage? She had no infirmity before the incident. I have contacted a lawyer friend but he has yet to get back to me. I believe now that even if just those who have said they would pray with me on this, pray for our deliverance from this bureaucratic mess, we will win out. Thank you to those who are praying for us. I'm sorry I did not put more info up, but I'm just so tired of thinking about this and no sleeping well. Thank you to all who are praying with us.

Soft tissue injuries are very hard to pin down. They do not show up well at all on X rays
Doctors will give you many different opinions on them
Doctors are semi-useless in this area

Rely only on how your wife feels. What the doctors say is irrelevant because THEY DO NOT KNOW!!!

You need to orient yourself totally away from the medical profession and totally towards the legal profession

What you need is the legal profession
Get a good lawyer or you are screwed for life if this injury gets worse in a few months (quite possible!!) and you damn well better go into that hearing with one otherwise they'll know you are a rank amateur and will screw you

GET A GOOD LAW FIRM.

I was hit by a car three years ago. L1, L2 and L4 were compression fractured.

To this day, I continue to walk with a cane and am in chronic pain. You cannot prove to someone that you have back pain because there is nothing that you can point to a screen that a lay person can wrap their heads around. They either believe you or they don’t.

Im in my second year of a legal tussle with the insurance company of the person who hit me and theyre trying to nickel and dime me to death. Theyve sicked private investigators on me and even contacted people Ive posted to on the internet.

It is imperative that on Monday morning you secure a credible personal defense attorney that will go to bat for you on a contingency fee contract. When 8 am comes on monday start calling till you find one that will see you. Also, remember that there is a finite amount of time that you can sue in.

I have gotten an education in this crap since I got hit..so trust me. It’s a dog eat dog mess..don’t let anyone take advantage of you.

You got everything but a good lawyer. You are an idiot! Stop being nice and go get one. Postpone the hearing if necessary. You don't bring a knife to a gun fight but this is exactly what you are doing.

Stop being nice!!! Defend your wife and family!!

If your wife hasn't gone to work since the injury and has run out of sick days there really isn't much the school board can do. Her medical insurance shouldn't be dropped because of that, though. If the evidence they are asking for is a prerequisite for extending her sick time, then they are trying to be helpful, IMHO.

If your wife is being threatened with discipline because her claims are contradictory to the other parties claims, then you need a lawyer.

If the school board is fighting the payment of workman's comp because of the injury, then you need a lawyer.

The safest thing to do is to find a lawyer. In workman's comp cases, I've seen school districts just replace injured workers, gambling that they won't defend themselves.

You don’t have to take worker’s comp if you’re injured at work. It’s a choice.

True enough.
But I do get a check every week coving about 80% of my take home pay and WC has covered all my medical bills without question.
I am thinking my case is unusual, as the insurance company has treated me very well. (My husband thinks it is because the company made a simple mistake and thats they I was injured.)

I know we have right on our side now I know we have His power on our side. Tomorrow, Monday I will be starting a series of moves, decisions and contacting people. I just need prayers that I will make all the right decisions and right contacts. I have contacted a lawyer friend and colleague and will be guided by him.
The whole issue rests on the answers to these three questions:
Did the incident take place? - yes we have my wife's statement backed up by a witness and her principal is totally supportive of her.
Is she disabled now? Yes, and we have a mountain of medical proof to back that up.
Was my wife infirmed before the incident, is this a preexisting condition? No,there is no evidence of that.
Why would I be so worried with all of this going for us? Because we are in the hands of an agency that has made bungling and lack of concern for it's workers an art form. We just don't want ANY kind of break in service, even for a single day, because we are trying to get my wife retired at the earliest possible time. I'll write tomorrow with what the day brings.
