BETRAYAL: Britney's Kin VS. UNLICENSED DR. Phil
New York Post ^ | Jan. 10, 2008 | David K. LI

Britney Spears' fuming family turned to the wrong person when they tapped blabbermouth Dr. Phil to counsel their daughter - he's not even a licensed psychologist.

TV host Phil McGraw allowed his license to lapse in Texas and never had one in California, where he tapes his syndicated show, officials in Austin and Sacramento said yesterday.

When "Dr. Phil" first aired in 2002, California regulators - concerned about McGraw's folksy, off-the-cuff commentary - convened a panel to rule if he was acting as a clinical psychologist and in need of a license.

"It was determined what he was doing was more entertainment than psychology," said Russ Heimerich, a spokesman for the California Board of Psychology, explaining why state officials passed on regulating "Dr. Phil."

Wichita Falls, Texas, residents may have something to say about Dr. Phil. Its where he located his practice for several years.

The premise of this article is completely stupid. Human psychology does not differ between Texas and California, and does not differ now from what it was a few years ago. Therefore, if Phil was a licensed psychologist in Texas a few years ago, he can use the very same brain in his skull to evaluate Britney in California today. For professional and legal reasons, he may not be able to charge her fees as a patient of his, but he is just as qualified to informally and freely advise her has he would be if Britney moved to Texas and he renewed his paperwork there (which lapsed because he left the state, not because Texas thought there was anything wrong with his qualifications).

At least one Medical Board (Louisiana) has opined that the locale of the patient determines whether or not the practitioner must be licensed or not. If a physician advises a patient in Louisiana or prescribes over the internet, he is practicing medicine in Louisiana and must have a Louisiana Medical License.

Several physicians have been successfully prosecuted.

You are correct.

Ministers also need credentials and get liscenced. Is Britney saying that she could not get help from someone if that person’s credentials had lapsed?

How would that apply to a physician traveling with a patient? Or, say, a doctor who travels with the President or Vice President?

I believe the jist of the article is that Dr. Phil talked about his ‘session’ with Britney, and they are upset about it.

However, because he is not licensed, he wasn’t practicing medicine, and therefore is not bound by patient confidentiality laws, so they can’t do anything about him talking.

If he WAS licensed, they could sue to get his license pulled, and maybe sue him for damages resulting from his breach of the confidentiality.

Anyway, that is MY take about why they emphasize that he doesn’t have a license.

Or, say, a doctor who travels with the President or Vice President?

Federally-employed physicians practicing within the scope of their employment are exempt from state licensing requirements. When I was in the USAF, I wasn't licensed in every state I was stationed in but as long as I confined my practice to eligible beneficiaries, I was OK.

Some Kentwood locals say troubled pop star Britney Spears would find refuge in her hometown.

He closed up his therapy practice after he was sanctioned by the Texas State Board of Examiners of Psychologists for unethical behavior.

"Twelve months after [a young female patient] filed a formal complaint against him, McGraw and the psychology board reached a settlement in the case: He would be publicly reprimanded, and his practice would be supervised for a year.

Before the year was out, McGraw had put his office up for sale and would shortly move to Dallas and begin CSI"

If he’s not licensed, I’m wondering if there IS any breach of confidentiality? Does his lack of license mean he’s just another guy on the street?

I think Britney needs some medicine. How about a dose of Dr. Molemans secret serum...

“It was determined what he [Dr. Phil] was doing was more entertainment than psychology,”

Anyone that doesn’t figure that out within 5 seconds of seeing him on TV, should have their head examined....and not by “Dr.” Phil.

Given that Dr. Phil is CLEARLY an entertainer FIRST, one has to ask the question: why would Britney’s parents seek him out? They invite an entertainer in to see their obviously trip’n daughter who needs some serious help and then they’re surprised when he tries to exploit the situation??? They are either really stupid, or just didn’t like the cut Dr. Phil was offering.
