Teacher in Teen Sex Case Arrested Again

TAMPA, Fla. (AP) — A former teacher serving house arrest for having sex with a 14-year-old student was arrested on charges of violating her probation, state records show.

According to a Department of Corrections report, Debra Lafave discussed her personal life and other subjects with a teenage waitress at a restaurant where both worked. One of the terms of her probation was that she was not allowed to have unsupervised contact with minors without permission.

Lafave, 26, is serving three years of house arrest and seven years of probation after pleading guilty to having sex with the boy in a classroom and her home in June 2004.

She was arrested Tuesday morning and released from jail on her promise to appear in court. It was not immediately clear when that hearing would occur.

Defense attorney John Fitzgibbons said he was disappointed that Lafave's probation officer ordered her arrest for what he called an "insignificant" violation. He said Lafave and the 17-year-old girl had a "typical workplace conversation that women have with their women colleagues."

"It was a workplace friendship — no more, no less," he said.

State attorney's office spokeswoman Pam Bondi said prosecutors would not comment on Lafave's arrest until the hearing.

Probation records show Lafave worked at a Tampa-area restaurant until last month, when her probation officer ordered her to quit. She now works as a receptionist at her mother's barbershop.

Fitzgibbons said he and his client were surprised by the arrest. "I don't think anyone felt this was a huge issue," he said.

He said Lafave has done so well on her first two years of house arrest that he plans to ask a judge to convert the final year to straight probation, which is less restrictive.

Other terms of her probation include sex offender treatment, random drug testing and 200 hours of community service, which she has completed.

Lafave pleaded guilty to two counts of lewd and lascivious battery in November 2005. She could face up to 15 years in prison for a probation violation.

Unlawful sexual activity with certain minors if someone age 24 or older engages in sexual activity with someone age 16 or 17.

Penalty - Up to 15 years in prison

Sexual Battery

(8) Without regard to the willingness or consent of the victim, which is not a defense to prosecution under this subsection, a person who is in a position of familial or custodial authority to a person less than 18 years of age and who:

(a) Solicits that person to engage in any act which would constitute sexual battery under paragraph (1)(h) commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

(b) Engages in any act with that person while the person is 12 years of age or older but less than 18 years of age which constitutes sexual battery under paragraph (1)(h) commits a felony of the first degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

This is rape.

The problem with adult women (even if sexy) going after underage males, since it spoils the young man into being a lush for sex, when they have no means other than masturbation (porn industry wins) and premarital sex WITH OTHER TEENS to acquire it.

If you didn’t know that teen-pregnancy is a sure recipe for poverty, now you know, and that’s what this 14 year old will be looking for, and inflicting on the 12 and 13 year olds around him. Just watch.

In short, by raping this boy, she has either activated him into a victim of the porn industry, or into a “stud” which will render many a young girl pregnant.

I am a Christian, and I haven’t even used, “Thou shalt not commit adultery” yet, along with the fact that God does not let adulterers into heaven, and eternal hellfire is waiting for them.

Please tell me you are joking??? As far as I know the only person that I can categorically say is in heaven, was a criminal worthy of the death penalty, that was on a cross next to Jesus. Put that in your high & mighty pipe and smoke it.

There’s no doubt that statutory rape has occurred in this case. I’m not arguing that point. What I am arguing is that the adult in this case likely did not force the teenage boy into anything. Legally, yes, this is rape, but rape of a willing victim.

And as for this teacher having “spoiled” this boy into being “a lush for sex” — do you actually know any teenage boys? I can assure you that when I was a teenage boy neither I nor my pals needed any “spoiling” with regard to sex. It was damned near all we ever talked about or thought about, all the time!

Please re-read my post. I did not claim that adult woman-teen boy sex was right, legally or morally; in fact, I flatly stated that any kind of extra-martital sex is wrong. I also never said that adult woman-teen boy sex wasn’t rape. It is, in a legal sense. I simply said that (rightly or wrongly) most teenage boys would welcome being seduced by a blue-eyed blonde woman of statuesque proportions, and I think most men on this forum would agree with me.

You can bet I will be watching Baby Chan most carefully as he grows up. By simply paying attention to his son’s activities and moods, a conscientious father can prevent small crushes from turning into big problems. Like fire, male hormones are a wonderful servant, but a fearful master.

Perhaps, but you are discussing a statutory rape case.

Unless you are a lawyer of some agencyperson whose job depends on these cases, one can’t help wondering why you have difficulty comprehending the difference between male and female in such cases.

Or do you simply like government becoming the 900# gorilla in these areas?
