Any family that has the name of their loved one on that shirt should sue this guy into oblivion. Second, legislation should be immediately passed, and made retroactive to 9/11, whereby no profiteering from the use of injured parties without their consent, punishable by minimal jail terms of 1 year and fines from $100K and up, should be introduced in Congress NOW !
This person has no sense of decency, and any gains from the blood of others should be ripped from his bowels.

This is fashion commerce, not “speech” or “art”.
People are permitted to paint ONE painting of Elvis on black velvet canvas, but when they are produced in volume, there is an infraction.
I’d think the same would apply here. You can make such a shirt in the singular but when you produce them in volume for commercial sale, you are trafficking on their names.
But turnabout is fair play.
Let’s draw up a shirt exposing the phony soldiers names and sell them from coast to coast. On the reverse put the Congressmen who voted to condemn Rush Limbaugh.

How is Bush’s lie responsible for car accidents, drownings, helicopter crashes, and a woman crossing the highway in Kansas?
The Left’s “Bush’s fault” death list is not a list of combat casualties. This is not to say these people didn’t die serving their country but they were included in the tally because it is far short of the 10,000s that they claimed we would be losing.
How many people died on base in America and other non-Iraq mission bases? Kuwait and German base deaths were included in this tally.

I think this "business" is an accident waiting to happen.
The lack of brain cells by these moonbats defies description. Between "Bush lied", "Bush was selected, not elected", etc., etc., they have no life and no common sense.
The scary part is that they can put the Hildabeast in the White House, and they will have NO income when she eliminates free speech. If he had anti-Klintoon merchandise, the Judge would have shut him down in seconds.

Harry Reid is essentially trying to do the first.
You're suggesting the second -- "ex post facto" is just another way to say "retroactive."
