Or are you referring to the a$#hole's "free speech" rights?

Sounds like he's committing a "Hate Crime", but then, we'd have to create some protected class to use that one (the families of Heroes)?????.

Article 1, Section 9: "No Bill of Attainder or ex post facto Law shall be passed."

Harry Reid is essentially trying to do the first.

You're suggesting the second -- "ex post facto" is just another way to say "retroactive."

Absolutely. The constitution prohibits both the US and any state from passing retroactive laws (not that that stopped Bush's 2001 retroactive tax cut or Clinton's retroactive tax hike or anything).
