1A tells what the CONGRESS may NOT do.
2nd tells everyone what every government may NOT do.
9 and 10 make it clear that not referring to something in the BOR or Constitution generally does not mean that it is OR is NOT a right.

Not entirely. The worst case of DUI involving fatalities in the nations history was a late 20’s or early 30’s redneck in a pickup truck going the wrong way on I 275 just outside of Cincinnati. 27 kids in a bus roasted alive as I recall. I remember witnesses testifying they could hear the screams....
I wouldn’t try citing that at a checkpoint...(chuckle)

My personal experiece wasn’t cited in the cases defending DUI checkpoints, so your point is moot. But I do appreciate the sentiments you expressed.
When a law that allowed the use of sobriety checkpoints was in force, the incidence of all crash fatalities was slightly greater (RR = 1.02, 95 percent CI: 1.01, 1.03). Similar results were obtained for deaths in automobiles and using miles driven as the denominator. However, among alcohol-related deaths, the direction of association was reversed (RR = 0.99, 95 percent CI: 0.97, 1.01) (table 4). Similar weak negative associations were found for alcohol-related deaths in automobiles and using vehicle miles as the denominator.

I’ve ‘been through’ this debate online for years, and it always ends the same way this one is, or will.
With DUI checkpoints enforced, and some posters decrying the death of the Constitution.
Its always the same in the end.
What is nice is for the most part I’m not being called a communist stooge, or worse....so far....(chuckle)
