Judge: Novell owns intellectual property in Linux case ( SCO Responds)

SAN FRANCISCO (MarketWatch) -- A federal judge's ruling Friday may help proponents of Linux open-source software sidestep a significant legal threat.

SCO Group Inc. does not own the copyright to Unix operating-system software, as it had claimed, and Novell Inc. is the proper owner, U.S. District Judge Dale Kimball said in a filing in federal court in Utah. SCO Group had sued Novell in 2004 for falsely claiming ownership of Unix.

In 2003, SCO Group filed a high-profile lawsuit against International Business Machines Corp. for contributing code to Linux open-source software that it said included some of SCO's Unix-related intellectual property. SCO claimed to have purchased rights to Unix from Novell in 1995.

That 2003 suit against IBM which has not been resolved, raised questions about the potential for other Linux proponents, such as distributor Red Hat Inc. to face similar legal claims

But in the ruling Friday, Kimball said that "the court concludes that Novell is the owner of the Unix and UnixWare copyrights."

Kimball added that Novell may now direct SCO Group to "waive its claims against IBM."

There are parts of Christian belief that are a must, deny these you deny the person of Christ and cease to be a Christian

And Fred Phelps fits that definition, thus technically Christian -- so he's right, I bashed a Christian. But I believe Phelps has definitely forgotten the morality as a whole that Christ taught. Strange, I don't have those three core beliefs, but I believe I act more inline with Christ's teachings than he does. I may not think he's a god, but you'd have to be an idiot (or a rabid anti-Christian) not to recognize him as one of the world's greatest moral teachers. Even the Muslims revere him.

AR, There are other things to consider I was just giving an example. Christ said you will know them by their fruits and he was speaking about going out and sowing the word so God would reap a harvest. Mr Phelps shows no fruit, nada, nothing!

It should, of course, be noted that weeping and gnashing of teeth is biblically the pastime in Hell.

That's where the No True Scotsman fallacy comes in. There are obvious criteria for being certain things. For some things the problem comes in defining the absolute core requirements of membership that nobody can disagree with. You can say he's No True Scotsman if he's from Bulgaria. It's easy with the Scotsman, where was he born? Christianity is more difficult, but I think the three requirements you mentioned are the core ones, and anything beyond that represents your particular interpretation of what it means to be Christian, thus invoking the fallacy.

Mr. Phelps puts more effort into sowing the word of God as he sees it than most Christians, that's why he's famous. Personally, I think he just puts too little emphasis on the New Testament, instead emphasizing the pre-covenant angry God.

Accident, I usually only post to this site from a cell. AntiRepublican obviously needs much more help than I, too bad you can’t get past phelps with the guy, he really is lost in life even seems to favor witchcraft over Christianity if you read his posting history. But what the heck, he likes Linux right, so you come bug me instead LOL.

Ahhh you post to yourself its an accident, I miss a capitalization (which I often do with proper names in all subjects and its a deep deep issue..

As to AR, I will continue to deal with him in truth and love with the knowledge that it is grace alone that has saved me, I do nothing more to deserve salvation than he. I will not count salvation as something to be credited to my credit but to his for God’s strength is best demonstrated in my weakness.

You go ahead and continue to spend all your time on FR on tech threads, and stalking people from tech threads not *once* demonstrating the compassion and love of Christ.. GE when it comes to the gospel AR is cold and you are luke warm.. I have never seen you make any statement of faith on FR.

No I don’t fight the atheists if not satanists in some of those threads, they are simply to evil for me to face. But to see you going around attacking various Christian denominations like you have been doing, then giving militant atheists like antirepublican a free pass does call into question exactly where you stand.

I have never said catholics were not Christians, and in my view of Mormons I agree with most every mainstream Christian denominates. What I do on those threads is debate theology which is what Christians should do within the body if you believe otherwise you have never been to a church board meeting. Heck in my small group there are always such discussions and these are people who I love, respect, and allow into my home.

GE If I get into a fight with my brother or sister (I have six of them) I am far more likely to yell, and be curt than a stranger. Do you know why? because they are in my family! If I discuss the same issue with a stranger Im much more likely to be polite.

I told AR he is hellbound if he does not find Christ (And to you thats giving him a pass). You have *never* acted as a Christian towards a non Christian on FR. You have *never* acted as a Christian towards your enemy on FR, thats very telling.
