It’s pretty obvious that the judge and prosecutor are playing right into the “jealously factor” and the “little rich white girl syndrome” — and giving the “public” their vicarious “pound of flesh” — because of the public’s self-perceived and unfortunate position of not being as rich or as white as she is.

For those who are as white or as rich as she is, and clamor for her incarceration (in the place of other hardened criminals who deserve it) — that’s playing into their own false image of themselves of being law-abiding and “righteous” so as to condemn anyone who falls into that situation (at least until their daughter or son “gets it” one of these days, and then they’ll be screaming and crying, too).

This is nothing short of a public display of how there is no “real justice” — but only perceived justice, aka the kind that we see at American Idol, where we can “dial in” the justice we want, by means of pushing either #1, #2, or #3 on the judge’s chamber’s phone.

This is nothing short of the public pretending to be interested in justice, while really only interested in getting at people who have either money or position better than themselves. It’s “celebrity justice” all right — but “against” celebrities rather than “for justice”.

If people were really interested in justice, there are a lot of hardened criminals and also illegal aliens to dispense so much justice towards, that we wouldn’t have time for any other kind of mastabatory public justice as is displayed here.

Just thinking out loud here: Suppose she has a serious medical condition—physical or psychological—which does make her an inappropriate subject for standard custody? Suppose further that the Hilton family wants this information kept out of the media because it might end Paris’ “career” or worse, expose her and the family to liability in case it is an infectious physical ailment. If they had argued the matter to the judge, it would have been part of the public record. So perhaps, instead, they chose to wait until Paris surrendered herself to the custody and jurisdiction of the sheriff and then pressed their case. The evidence convinced the sheriff that release was appropriate (credibly or not) and she went home in the dead of night. Case closed and confidentiality maintained. Except Judge Sauer wasn’t involved in the decision and hailed both the sheriff and Paris back to court. The sheriff promised to produce documents to back up his decision but perhaps the Hiltons refused to allow the documents to be brought before the judge. So the sheriff takes the fall (perhaps to be cushioned later) and Paris ends up serving her time but at least the public doesn’t get to discover her secret(s). Again, just speculating but it seems to me a plausible explanation for the fiasco.

It’s precisely because of this jealousy factor and the public seeing a way to “get back” at people who dare to have circumstances better than they find themselves in — that this is happening this way.

If this was a “nobody”, someone who came in for the very same thing, they would have been released, at the maximum, to house arrest and given a “work-license” to drive to work and be required to stay at home during the other hours. I know that from having seen it happen directly to people that I’m acquainted with.

This is simply justice aimed at putting down someone that the public perceives as being better off than themselves. It’s “celebrity justice” aimed at and against celebrities, for no other reason than just that.

As far as PH is concerned. I think her attitude put her in jail more than her crimes. But right night she is caught in the middle of a power struggle. and I can say is a big ole southern "Bless her heart"

If she'd been a nobody, said nobody wouldn't likely have had the brass to give the judge a hard time. To violate her probation twice. To flip the bird at the law. If the judge threw the book at her it was because she invited it. How many poor and downtrodden do you know who do that?

I have no idea if the sentence is "common" for this jurisdiction. I do know that it is "just" because it falls within the sentencing guidelines. Technically, it would have been "just" to give her 90 days.

I agree that women shouldn't be in a war zone. But the reality is they are. So I have a hard time working up sympathy for someone who goes catatonic over a 22 day stint in jail where she has to -- gasp -- be alone in climate-controlled cell with plumbing and a bed.

Actually your article confirms exactly what I said. This is the first time, to my knowledge — and your link doesn’t suggest otherwise — that Baca’s action specifically defied the judge’s instruction. It may be an established tradition that inmates get early release due to over-crowding etc and the court system may, indeed, be annoyed by this. And those instances may, indeed, be within the sheriff’s discretion. And the judge, knowing this, gave very specific limitations to close that loophole in this case. That is the point. To my knowledge, there has been no other case in which Baca deliberately defied the court’s instruction. Baca knew he needed the judge to sign off on the release and chose to skirt that.
