MARTINEZ -- Convicted sexual predator Cary Verse will be allowed to return to his Bay Point home under certain conditions after he violated the terms of his release by repeatedly having a 14-year-old boy in his car, a Contra Costa County judge ruled today.
Verse will be allowed to live in the cottage beginning June 11 because the medical director at Atascadero State Hospital has concluded that "he would not be a danger to himself or others," said Superior Court Judge John Kennedy, agreeing with a recommendation by Deputy District Attorney Brian Haynes.
"Based on all the evidence before me, on the preponderance of the evidence, I believe that it is safe to return Mr. Verse to the community under conditional release," Kennedy said at a hearing in Martinez.
Verse served three years in prison and spent six years at Atascadero before initially being conditionally released from the hospital in 2004.
In January, the judge ordered Verse back to the hospital for inpatient treatment after Walnut Creek police found him driving with a boy in his vehicle in November. Although nothing untoward had occurred, Verse had not gotten written approval to be with any male alone. The judge also found that Verse had tried to hide his associations with people with criminal histories.
