Then, just last month, the director of a DNA laboratory that tested samples taken from the woman testified that he and the prosecutor had agreed in May to withhold some of the findings. The exculpatory nature of the results - specifically, that the swabs included traces of semen from several men, none of them the Duke defendants - offer the strongest evidence yet that the prosecutor himself should be the subject of an investigation, and that he should have no further connection with this case.

Spoken like a true lady.
"I think it is likely item 3 or the false affidavit part of item 2. It also could be other ethics issues completely unrelated to these three issues."
I agree with you, but Time.com says it will be the DNA conspiracy. It wouldn't be the first time MSM got it wrong, but I hope they're right this time.

The Dec. 28 ethics charges are expected to be expanded when the state bar's grievance committee meets again Jan. 18. Like a grand jury, the committee meets periodically; the current ethics charges stem from its most recent meeting in October and cover public statements Nifong made about the case last March and April. At its next meeting, the committee will deal with revelations from a Dec. 15 court hearing in which the state's DNA expert admitted he and Nifong agreed to keep secret from the defense early DNA results showing no Duke lacrosse player could be implicated in an attack upon one of two exotic dancers hired for the March 14 house party.
I think the DNA conspiracy will be later. I just think the investigation and Nifongs period to reply is more than a month.
Kemp stirs the pot more over at Durham in Wonderland:
"I just returned from meeting, AKA drinking, with my Bar buddy.
The Bar Grievance committee will meet next week, MORE trouble for Mikey. I mentioned last week that my friend thought Mikey would surrender his law license next week.
Why?
I really don't have a clue, unless the Bar is going to say, Mikey resign and give up your license, or we are going to ask Roy Copper, NC AG, to prosecute you for lying, etc.
He is a DEAD MAN WALKING.
This will be over VERY SOON.
Mikey can only hope the Fed's don't go after him. Maybe that is part of the deal, we will not push the feds, you get the HELL out of here and dismiss all charges.
Kemp"

I think unless Nifong gives up the ghost there will eventually be charges based on the DNA conspiracy. So they could be right away, but I still think the other two items I mentioned are in legal terminology more ripe right now.
Nobody can find something on the web faster than maggief. Glad she's getting recognition outside of FR. She deserves it. She's the best.
Huzzah, maggief!!
By now the entire country knows this case should never have been brought. To delay the dismissal is to add to the injustice.
I'd love to know who Nifong has retained to represent him on the ethics charges.
You know there are beind the scenes talks going on now. Wonder what deal they're going to cook up.
When I asked the guy over there if this could come out so quickly he said, he is talking a deal with Nifong. Some thing along the lines of surrender his law license for five years and resign in return for no prosecution?
Again you can read lots of things on the internet and this guy could have it wrong or his NC Bar friend could have it wrong or it could happen or it could be in the cards now but fall through. So you never know.
Prosecutors have somehow taken over our country and the lives of all of us are under threat from them. They're grandstanders like Nifong or Spitzer and they decide they don't like you or want to make a point or advance their careers. What happpens? You're toast. They are completely unregulated and unsupervised free agents who make the Grand Inquisitor look like he wasn't really trying.
They have to be talking a deal. And the only way a deal is being discussed is if Nifong is represented. You don't negotiate for yourself in a matter this serious.
That's a very strong article in Time. Nevertheless, I don't see him surrendering his license. IMO Nifong has not been a rogue prosecutor. He's had the imprimatur of someone higher up all along to act the way he has. Nifong will be protected to some extent. But I do think at the very least, he's going to be off this case very soon. The big question for me is will he keep office and his pension. I tend to think that he will and once this case is over, he'll only get a reprimand. I don't think he'll run for office again.
We have to let the healing begin. Don't you know that?
I meant to say that I too would be curious to know that he has retained an attorney and who it is. I agree, even Nifong is not so stupid as to negotiate that for himself.
The empirical data could be construed to mitigate that estimation...
You know, I really have mixed feeling whether Nifong's going to be forced out of office. And that private "get back to work" swearing in ceremony really gives us some insight.
Yes, I thought Nifong acted his old arrogant self in that bizarre post-ceremony news conference. But the fact that he did not want and prevented video of himself being sworn into the office for which he sold his soul really speaks volumes. Maybe he does know that his days are numbered.
Kemper (think that's the blogger's name) has been on the money with his bar inside source. And again, that is a powerful article in Time. I'm shocked that there have been so many leaks out of a bar's disciplinary committee.
Well he is certainly so far over the line he is hurting other lawyers, other prosecutors etc. And they are acting to protect themselves. That is why I believe they are going to act against Nifong.
BTW, Nifong is really only in trouble for violating one of the fundamental rules of being a bully prosecutors.
The scandal that could be called Duke's "Curtis-gate" is showing signs of intensifying.
