I agree with you that 10% of the people are 90% of the problem. This is true of almost any crime. But that does not change the fact that driving while impaired is still a stupid and irresponsible thing to do, and should be illegal and punishable by law.
Sure, throw the book at the habitual offender. I agree that the penalties for habitual offenders are too light. But there should also be a penalty to be paid for driving around at 0.08, because you are much more likely to get into an accident at that BAC. The Police can do both at the same time.
