Yeah, I don't get it. Mel Gibson's BAC was not very high, either. You should be barely tipsy at .08. The reason they make the legal level so low is to make it more likely drinkers will be caught.

99% of all drinking and driving problems are caused by people who are profoundly drunk. Therefore, let's lower the BAC level to the "got a slight buzz" group to address the problem.
