Cab driver in lacrosse case acquitted (DukeLax cabbie escapes Nifongery)

The Durham cab driver who has surfaced as an alibi witness in the Duke lacrosse rape case today was found not guilty of a 3-year-old shoplifting charge.

Moezeldin Elmostafa is expected to provide an alibi for Reade Seligmann, one of three Duke lacrosse players indicted in the rape case, because he gave Seligmann a ride after the party that led to the rape allegations.

After authorities learned of Elmostafa's potential role in the rape case, they found an unserved warrant naming him in a 2003 shoplifting case at a Hecht’s department store at Northgate Mall in Durham. A security officer for the store testified today in district court that he saw a woman steal handbags from the store and then jump into Elmostafa’s cab, which sped away.

The security officer testified that the cab pulled away even before the woman had closed to the door. A store surveillance tape, played in court, appeared to show that the door closed first.

Defense lawyers in the lacrosse rape case have said that Elmostafa was charged because he is a favorable witness to the defense. Loflin put one of the lacrosse investigators on the witness stand this morning and produced typed notes from the lacrosse case that show District Attorney Mike Nifong wanted to be informed when Elmostafa was arrested.

Assistant District Attorney Ashley Cannon told the judge the shoplifting case has nothing to do with the rape case.

"7:15 PM 06/21/2006: I do not believe there was no toxicology test done. I say there WAS one done, that it is negative for date rape, and we will know this somewhere around August 29 or August 30."

I want to take a minute to say something. I'm very, very proud to be associated with all of you on Free Republic in this important search for truth. Early on, Howlin kept the threads going and pinged new articles and set up the threads. As she went on to other things, I made up my mind I was going to see this thing through to the end.

And for a long time, Free Republic was IT. No other blogs, bulletin boards or anything. WE stayed at it though. I want you all to know I'm extremely glad we hung in there. We may not get the credit - the other blogs may claim the glory. But I know what YOU ALL did, and I'm very proud to be a part of it.

This is HUGE news if Nifong knew of a tox report all along or am I missing something?

I think Nifong was too clever by half in his parsing. The accepted wisdom has been that there was NO toxicology report done, and Nifong did nothing to dissuade that opinion. It's another bite out of ass he doesn't need right now.

Forum rules prevent me from posting what I really think of this.

Good for the officer. That he put tidbit to paper is a good sign he was CYA'ing himself - deservedly so, or actively sinking the DA.

About calling these officers "a-oles", could you point to me to what the ones mentioned in this article did to deserve such a tag? I am familiar with Gottlieb's belated memo which is certainly suspect, but what about the others?

I'll take a whack at this. Any sworn officer of the law that keeps quiet when he/she knows a frame-up is ongoing or abets the crime is a disgrace to his/her badge and is deserving of the public's contempt and scorn.

No one can make me believe that Nifong and Gottlieb are doing this by themselves. Others in the DPD know what is going on. And they know we know...

10) Investigator Himan (under the supervision of Nifong) included the following (false) sworn statement in a probable cause affidavit issued March 23 in support of an Identification Order that compelled 46 members of the Duke lacrosse team to give DNA samples and submit to being photographed: "Medical records and interviews that were obtained by a subpoena revealed the victim had signs, symptoms, and injuries consistent with being raped and sexually assaulted vaginally and anally. Furthermore, the SANE nurse stated the injuries and her behavior were consistent with a traumatic experience."

It is impossible for the subpoenaed medical records and interviews to have been in the possession of Himan or Nifong on March 23 because the Duke medical records (obtained by Himan via Himan’s subpoena) were not printed by Duke Medical until March 30 and Himan did not pick them up at Duke Medical until April 5. Further, the Duke medical records released to date are entirely inconsistent with Himan’s statement in the affidavit. (Note: the same probable cause language was included in a later March 27 probable cause affidavit.)

What the hell are those a-holes doing there???

Getting in a picture they wish they could avoid. Could be they were called by defense in this case. That is probably the only way the defense could get in that he was arrested only because he was a witness for Seligmann.

Is it my imagination or is the N&O helping the Duke 3 here by showing the white police officers scowling, in an almost classic Rod Stieger southern cop way, at the poor black man?

That was my take on that picture too.

Nope, Nifong said no tox report was available, not that there was no tox report. He was stone walling on discovery as many suspected. He is a Clintonian Dim.

Taylor really hits on all the points.

Taylor's article was very good. I did regret that he failed to mention that Mangum picked 4 people in that rigged last photo array and Gottlie ignored one of them.

Thank you for all your input on these threads, especially keeping us informed with the latest information.

It's my belief that FR is a collaboration of many talents; experts, bloggers, researchers, investigators, insiders, activists, and a host of others in search of the truth. FR may not get credit but we are making a difference. MSM and politicos are taking note. The Durham realm may be slow learners.

Students of body language (arms crossed, lips tightly pressed together) will recognize that the two cop thugs are hearing (or expecting to hear) something they don't want to hear....NOT GUILTY!!! And seeing something they don't want to see -- the first of the Nifong/Gottleib house of cards beginning to fall. And Elmostafa does look calm AND VICTORIOUS; I'm VERY proud of him for standing his ground. He's paid the price and earned the right to look calm and satisfied. Elmo, you really are da man!!

You called that one right. One of the things this case has done is cleared me of the illusion that the NAACP, even at the local level, is really interested in any of the things it talks about (like justice, equality, brotherhood, etc.)

It's just about race-baiting and their leadership using race to keep their own positions. (Try bringin a case before them where they could really do something about justice and racial harmony--like this one--and they rally around the race-baiters.)
