DURHAM, N.C. -- A cab driver who has supported an alibi offered by one of the three Duke lacrosse players charged with rape had his own court appearance Tuesday for a larceny charge.
Moezeldin Elmostafa, 37, appeared briefly before a Durham County District Court judge who set a trial date of Aug. 29. Prosecutors also changed the charge against Elmostafa to aiding and abetting misdemeanor larcency.
Elmostafa was arrested in May after he surfaced as a potential alibi witness for Reade Seligmann, one of three players charged with raping a woman at an off-campus party the night of March 13.
The 2003 warrant accused Elmostafa of stealing five purses worth about $250 from a Durham department store. Elmostafa denies the charge, and has said he helped store security locate a woman after he picked her up from the store and drove her home. The woman later pleaded guilty to larceny.
Durham prosecutors said in May the warrant for Elmostafa's arrest was discovered in a routine background check of witnesses in the Duke lacrosse case.
Mostafa has said Seligmann, of Essex Fells, N.J., called for a ride at 12:14 a.m. on March 14, and was picked up five minutes later. The defense has argued those times help establish that Seligmann left the party without having enough time to participate in the 30-minute assault described by the accuser. Seligmann's attorney has also presented cell phone, ATM and dorm keycard records to help establish that timeline.

I did suggest in my post it will be a battle between the feminazis at CBS v. the people who identify with the defendants and see a dumb southern prosecutor in this. So we shall see and sorry Mike I would not bet one way nor the other.

1. Cash Michaels' turnabout on the DA's case was a signal that some elements in the black community are ready to cut their losses, and throw Nifong from the train. I doubt that Cash would do such an about-face unless he thought he had the backing to get away with it (or even gain from it).
2. By now, 60 Minutes has had a chance to see that Cash's new stance has received a favorable reception by Duke Lacrosse defenders - while at the same time, it has not generated much criticism from the other side.
3. As a face saving effort, Ed Bradley hits the angle that the black community in Durham was deceived by Nifong.

Convicted on that charge on 12/11/2003 got a Suspended sentence (or probation)
FIVE DAYS LATER, Mrs. Hawkins is arrested for shoplifting again (on 12/16/2003) - and on March 24, 2004 is convicted and jailed on that same day for that offense.
Nifong's office is going to have to hurdle the fact that this woman didn't need Elmostafa's help - and her past indicates she's out of control rather than a calculating criminal.
Her crimes all appear to be misdemeanors - and she's been arrested for Drug possession and Drug paraphenailia charges.
Her Driver's license has been revoked multiple times.

Next Monday may be moved back.
They need approval on this Judge. So, that date may move, but, theoretically, it should move MUCH faster once this Judge is appointed. I would think it's a rubber stamp - Nifong agreed already.
The Defense attorneys did an END RUN here - they got a Judge from Outside Durham. They had to hold something over some heads to pull this off!
No word on whether Judge OSMOND, will be a little bit Country or a little bit Rock N Roll !

How much irony is there in these morons in the Durham court house having to designate a case special that they VOWED to treat no different than any other.
BTW, the article says the hearing may be postponed. Judge Smith is so far only nominated to take over. The Chief Justice of the NC Supreme Court has to sign off on this, I think.
And now with Judge OSMOND Smith we won't have to wait until the "12th of never" for a trial, right? Perhaps Nifong will send the 3 guys some "Paper Roses" to apologize. And if the ABN campaign works and Nifong gets ousted as the DA he can tell the AV to "Meet me in Montana" for some "Puppy Love". Should I keep going?

I hope he's going to be fair and I hope this speeds things up. If this absolutely has to go to trial it would be nice if it happened this century.

The Jury is out on the rest. I wonder if this signals that the Durham Judges didn't want any part of this thing?
It seemed like Stephens and Titus wanted nothing to do with the case and that may be true for most of the judges in Durham.
I really hope Smith is good because if this deal goes through he's going to have alot of power.
How fast will this decision be made, I wonder?
