Dyleski trial opens today in Martinez

Attorneys in the trial of a teenager accused of killing of a woman as part of scheme to use stolen credit cards for purchasing marijuana growing equipment will give opening statements today in Superior Court in Martinez.

Scott Dyleski, 17, is charged with murder and burglary as an adult in the Oct. 15, 2005 killing of Lafayette resident Pamela Vitale. He has pleaded not guilty.

Court administrators will to assign 14 seats through a lottery to be held at 8:15 a.m. on the east side of the A.F. Bray Building, 1020 Ward St., Martinez.

I'm hoping he'll call Susan Polk as a Defense witness.

I wonder if the kid will claim to have been framed by her husband....who was having an affair,was planning a divorce
and didn't want to lose half his wealth and was anticipating a big life insurance payout to settle the huge gambling bills he had run up.

That's exactly what Susan Polk said. But then, her son testified under oath that she is "Cuckoo for Cocoa Puffs."

OK,she may well be a bit off her rocker but even crazy people give accurate info some of the time.

IMO,the defense would be negligent if they failed to check out *every* bit of the husband's history....girlfriends,boyfriends,gambling habits,drug/alcohol use,Mafia ties,psychiatric history,etc.

I can't argue that point, especially after what Polk said about him. The good news for Dyleski (unlike Polk) is that he does have a real lawyer. I'd bet that his lawyers, and even the prosecutors, are putting Horowitz under a microscope.

I'll also bet that they don't come up with a thing.

Prosecutor Harold Jewett got the Death Penalty for the Helzer brothers and has 24 years of experience as a prosecutor.

Public Defender Ellen Leonida is a UC-Boalt Hall graduate with 9 years experience as a Defense attorney.

These aren't rookies. Yeah, they're looking at Horowitz.
