Wasn't Finnerty punished or held accountable because he was supposedly the instigator. YES, I remember news Headlines saying the Finnerty was called the INSTIGATOR, but he didn't touch the victim.
The INSTIGATOR here was BALD and it's not either guy charged !

So what is the theory?
1. Initial confusion about the instigator?
2. Tanner and Lee taking the fall for Gottleib and Clayton?
So the Question why wasn't the instigator the man that started it - charged? The bald guy was an instigator - he took the initiative to stop and approach the cook - yet, he's not charged - no matter what his name is. The Bald guy should be charged.
My personal opinion is the two charged are being scapegoated.
