Yet Nifong is thrilled he got indictments because it got him elected.

I'm glad to see the Herald Sun finally come right out and print this, even if it has to be a quote from an attorney.
Probably the first time, in any context, that this plain truth has been stated so plainly in print (in Durham or anywhere else).

Well Judge Titus has tried to establish this tough guy reputation. He took judicial notice of the NC bars rules of ethics concerning out of court statements.

Then Nifong gets up in his court and makes such a statement putting it in Titus' face. And Titus does nothing upon hearing such a statement in his court.

We shall see if Titus does anything about Nifong in his next hearing. I certainly don't hold out much hope and when he does not please spare me the articles on how firmly he runs his court room.

Durham DA challenge still in doubt

As each day passes the worse this looks to me. If Cheek doesn't say he will run there is no pressure on Nifong to do the right thing. This whole thing is going to be dragged on unnecessarily till next spring if nothing is done. It might be time for the Duke players legal team to open up a new legal front on all this and try and open up a civil lawsuit. This thing might go away if people started to have to go in for depositions.
