Nifong: Every Member Of Duke Lacrosse Team A Potential Witness

Every member of Duke University's men's lacrosse team is a potential witness in the case against three players charged with rape, Durham's lead prosecutor said Monday while arguing for access to their student ID card records. "We want to be able to confirm what they tell us about where they went afterward," District Attorney Mike Nifong said of the uncharged players.

Titus also formally reaffirmed the state's rules governing trial publicity and disclosure of information to the public and the media. The order does not prevent attorneys in the case from talking publicly, but does prohibit statements that have a "substantial likelihood of materially prejudicing" the case. "The rules of professional responsibility require us to be very careful of what we say," said Wade Smith, one of Finnerty's attorneys. "We'll do that. We've been doing that. And we'll continue to do that."

now I have no confidence in the judges there, either.

All Democrats. Rats have been corrupting the judiciary for years. Imagine what this country will look like if they get back in power again.

Finnerty's father is a Wall Street Broker?
Evan's father is a K Street lawyer, Mom is LPGA.
Bob Bennett is on the equation.
Mark C. (too lazy to look up spelling) is helping with Finnerty.

There are many major players in this story, not too mention major players who are Duke Alumni.

Duke is connected to the DC Establishment...I wonder how many beltway kids went to Duke? How many were rejected by Duke?

As for the trial in Durham, I am not holding out much hope especially after what I have seen lately. Cheshire was bitch slapped a few weeks ago. Osborne was bitch slapped yesterday. Nifong will get his judge. Nifong will get his jury. There is a good chance these boys will be convicted.

When they are convicted that's it, they will go straight to State Prison. The system has failed these boys every step of the way and unless someone steps in or those of us who see these boys being lynched dig up some major dirt in Durham, those boys do not have a snowball's chance in hell.

you have to figure if the race of the victim isn't talked about, its a black on white crime......

shouldn't Nancy be made aware of this horrendous case?....shouldn't all the black sympathizers?.....

I am sure Goose will say that the poor "boys" were just underpriviledged and misunderstood.....

There is certainly little chance any of the NC judges in rotation are going to stop this; unless it gets too hot for them. And that is our job.

First, the AA community has to turn. It has to question if the case is a hoax. If the support of the AA community for Nifong is lost, then the case is won.

So, we have to inform the AA community--in their media, periodicals, newspapers, the BET, etc., of the facts.
It will be a slow process but it can be done. Change enough minds, one by one.

And try and get a major black figure to go down to NC and interview the AV. She probably doesn't want to continue with this case but has been intimidated by Nifong.
Have the black leader promise her legal support if Nifong comes after her for something on her record; and get her before microphones to tell not only what really happened, but how Nifong has been intimidating her.

If that happens, then the case is over.

Because otherwise, it's headed straight for a train wreck.

And then there are all those baby-boomers up in New York and New England who were thinking about retiring and moving to North Carolina.

Many of them thought the research triangle was the perfect place to move. They're now checking out South Carolina and West Virginia.

Does Governor Easley have any idea of the damage?

Agree 100%. But that's an incestuous lot there in Durham, and Nifong doesn't have to work very hard to prevail.

Back to the payoff idea; is there any thought that Nifong is still pursuing this case--in order to increase the size of a later payoff demand?

If you had a son headed for the NC big house, what would you pay to keep him out? The more desperate you get--as the case seems to swing more and more in Nifong's favor during the trial--how long would it be before you would crack and listen to an offer?

And maybe the rot (and the payoff) runs all the way up to the governor's office? (In Louisiana one man is said to have paid $200,000 for a pardon. How much can the parents of the Duke three pay?)
If Durham is worse than LA, isn't that a possibility?

And remember the earlier 2002 rape case, in which the white defendant got immunity for accusing a black man. Why did Hardin-Nifong accept that deal? Did they suddenly out of thin air just want to help the white man escape the rape charge? Or was there a payoff?

I'm asking questions, I don't know. But so many strange things happen in this case that I'm looking for an answer.

It's hard to cut the smart people out from the herd. Raleigh-Durham has numerous groups of professional socialist malcontents who are experts at grant-writing and shit-stirring. Every group imaginable has hopped on this bandwagon, hoping it will lead to VAWA funds. They, and their sockpuppets, can be read on almost every online messageboard. They try to thwart intelligent discussion of this important case.

I suspect Nifong is thinking his office might be eligible for VAWA funding because of the expense of prosecution involved in this bogus "violence against women" case. His comment about FERPA showed him to have federal funds on his mind.

Nifong didn't strike me as the shakedown type - well, for glory maybe, but not money - but you could be onto something. I don't rule anything out anymore. But it just doesn't seem like he would pull this with out-of-towners. It doesn't "feel" right to me.

He doesn't strike me as that type, either--except there was that other case where a white man got immunity for accusing a black man of rape--and so got out of prosecution himself.
There was no reason in the world for Hardin-Nifong to do that--except maybe that there was a payoff? That's the only reason I can come up with this early in the morning.

So, that might suggest that there is a pattern.

And I can't imagine why DC would go out of its way to help Durham. In the early stages of the case, maybe--when it was still possible to think there was a case. But now, when it is impossible not to know this is a hoax, why would Bayly go cooperate? Again, there's only one reason I can come up with. It's absurd, maybe--but what else about this case isn't? Is Bayly that obtuse, that he would knowingly help out a hoax?

I'm glad to see the Herald Sun finally come right out and print this, even if it has to be a quote from an attorney.
Probably the first time, in any context, that this plain truth has been stated so plainly in print (in Durham or anywhere else).

A well written letter that hopefully will get the attention of the more open-minded Trustees. I could do without the Kantian ethics allusion and to list only four areas where Nifong has failed to act in accordance with the law, legal ethics or principles of fairness is being way too kind.
