Phone use spans time of team party

In the middle of a Duke lacrosse party where a dancer said she was gang-raped for 30 minutes, a call was placed from her cell phone to a Durham escort service.

The 12:26 a.m. call to the service, Centerfold, lasted one minute, according to a copy of her cell phone bill reviewed by The News & Observer. It is unclear whether the call was a request for another job, a cry for help or something else, or even whether the accuser made the call herself.

But the accuser's phone records add some details to the chronology of the March 13 party, a drunken spring break bash that spawned a national controversy.

Neither prosecutors nor defense lawyers would discuss the phone records Tuesday. Neither the accuser nor a second dancer at the party could be reached, nor could representatives of Centerfold. Police Chief Steve Chalmers was out of town; his spokeswoman said he would not discuss the case.

Three players have been charged with first-degree rape, sexual offense and kidnapping: Reade Seligmann, 20, of Essex Fells, N.J.; Collin Finnerty, 19, of Garden City, N.Y.; and Dave Evans, 23, of Bethesda, Md. Lawyers for the players have proclaimed their clients' innocence and said no rape or sex occurred at the house at 610 N. Buchanan Blvd.

District Attorney Mike Nifong, whose handling of the case has undergone national scrutiny, has been adamant that the woman was raped at the party. Nifong has not given a precise timeline of when he thinks an assault occurred.

Stephens finally ruled that the records could be released at one of the hearings. I saw it on TV. Copies of the records went to the DA and the defense at that time.

Yep! But there wasn't a definite date for the release. IIRC the Nifong crowd was still doing something with the cell phone. And any release of the records would only be to the defense -- not to the public.

Does this mean that the records HAVE been released to the defense? And if N&O got Crystal's cell phone records from the defense, why didn't it identify the source?

Yep, she is outside at 12:26 for sure, imo. She couldn't get back in to make more money, she was mad at Kim, and she needed a ride. She made that call from the back porch.

She could not get a ride, I'll bet.

Of course as Nifong SAID IN OPEN COURT, he could not imagine what evidentuary value Magum's cell phone could have.

In addition to all the facts that suggest the Duke players did not rape the AV, the additional timeline information suggests that applying Occam's Razor we have to conclude that the AV is lying. In other words the litany of assumptions you would have to make to support the AV's allegation is mind numbing.

From Wikipedia: Occam's razor states that the explanation of any phenomenon should make as few assumptions as possible, eliminating those that make no difference in the observable predictions of the explanatory hypothesis or theory.

Tuesday afternoon, Davis and Scott, both former Reedley College football players from Florida, were formally charged with one count each of a lewd act upon a child. If found guilty, they could serve as many as eight years in prison.

The criminal complaint reveals little about the case, saying Davis and Scott had "substantial" sexual contact with her.

The suspects were initially arrested by police on charges of child molestation and oral copulation. A spokesman for the Fresno County District Attorney's Office, Bob Ellis, said the lewd act charge covers the same ground.

"You could charge both, but they cover the same conduct," Ellis said. "And the punishment is the same."
