Stephens finally ruled that the records could be released at one of the hearings. I saw it on TV. Copies of the records went to the DA and the defense at that time.

Yep! But there wasn't a definite date for the release. IIRC the Nifong crowd was still doing something with the cell phone. And any release of the records would only be to the defense -- not to the public.
Does this mean that the records HAVE been released to the defense? And if N&O got Crystal's cell phone records from the defense, why didn't it identify the source?

Tuesday afternoon, Davis and Scott, both former Reedley College football players from Florida, were formally charged with one count each of a lewd act upon a child. If found guilty, they could serve as many as eight years in prison.
The criminal complaint reveals little about the case, saying Davis and Scott had "substantial" sexual contact with her.
The suspects were initially arrested by police on charges of child molestation and oral copulation. A spokesman for the Fresno County District Attorney's Office, Bob Ellis, said the lewd act charge covers the same ground.
"You could charge both, but they cover the same conduct," Ellis said. "And the punishment is the same."
