A couple of months ago, some reports were circulating that GW and the Dems (remember when they had that secret meeting -- without the anti-illegals Pubbies) have an agreement:

If the amnesty (whatever they call it) bill passes, all is good.

If the amnesty (whatever they call it) bill fails, they will just issue massive numbers of green cards, thus making those illegals legal by default.

Since it has stalled, we have 'status quo'. So not much has changed, catch and release is still going on, massive numbers of illegals are still flooding in. It is still a shellgame.
